【摘要】：房屋的征收和拆迁是事关人们生存基本权利的一项重要内容,它不仅关系到被拆迁人的合法权益能否得到有效保护,也关系到社会正常的运行与稳定发展。由于其中涉及到的多方主体和复杂利益,如果处理不好则会引发一系列的社会问题,严重的甚至还可能引发恶劣的群体性事件,影响社会的和谐稳定。我国的法律一直致力于保护房屋拆迁中被拆迁人合法权益,对于房屋拆迁补偿的法律规范从1953年的《国家建设征用土地办法》到2011年颁布执行的《国有土地上房屋征收与补偿条例》,其间历经数次修改,每一次的修改都是对于房屋拆迁补偿机制的完善,也是对于房屋拆迁中被拆迁人合法权益保护的一大进步。尽管如此,但是在实际的房屋拆迁中侵害被拆迁人合法权益的事件仍时有发生。本文以房屋拆迁中被拆迁人合法权益的保护为题,探讨如何通过行之有效的措施,减少或避免侵害被拆迁人合法权益的事件发生,从而达到充分维护公民合法权利,实现社会稳定健康发展的目标。一是对房屋拆迁中被拆迁人的权益进行了简要的概述,以介绍法律意义上房屋拆迁的涵义与特征为基础,从所有权、财产权、其他权益等三个方面阐述被拆迁人的权益内容,并从当前存在的突出矛盾总结了被拆迁人权益保护的现状。二是重点论述了房屋拆迁中被拆迁人权益保护存在的问题,并着重分析了产生这些问题的深层次原因。分别从拆迁单位强势拆迁、评估机构违规评估、暴力强拆时有发生等方面描述了存在的问题,从“公共利益”界定模糊、立法保护不足、监督检查缺位和权利救济不到位等方面分析解释了被拆迁人合法权益难以获得有效保护的原因。三是探讨完善被拆迁人权益保护的对策。从提升立法等级、完善法律内容和相关程序规定入手,着力在立法上完善被拆迁人权益保护机制；以确立分类拆迁制度、明确公共利益、完善评估机制、完善补偿机制、加强住房保障等方面为主要内容,力求进一步推动房屋拆迁执行工作合法合规；建议从加强监督约束、提升监督级别、保证监督独立等方面建立健全监督检查体系；通过畅通群众监督渠道、完善司法救济途径、打击违法犯罪行为等方面拓宽被拆迁人权利救济的途径。
[Abstract]:The expropriation and demolition of houses is an important part of life is related to people's basic rights, it is not only related to the legitimate rights and interests of residents can be effectively protected, but also related to social operation and steady development of normal. Because of the main parties involved and complex interests, if not handled properly will lead to social problems a series of serious, even may cause severe mass incidents, affect social harmony and stability. The law of our country has been committed to the protection of housing demolition in the legitimate rights and interests of the demolition, the house demolition compensation law in 1953 from the "national construction land acquisition measures" to 2011 implementation of the promulgation of "state-owned land on the housing levy and Compensation Ordinance, which have been modified several times, every change is perfect for housing demolition compensation mechanism, but also for housing demolition demolition and A great progress of rights protection law. In spite of this, but in the actual housing demolition in violation of legitimate rights and interests of the demolition events still occur. The housing demolition was to protect the legitimate rights and interests of the demolition of the theme, to explore how the effective measures to reduce or avoid infringement of legitimate rights and interests of the demolition event happen, so as to fully protect legal rights of citizens, to achieve social stability and healthy development goals. One is the demolition of housing in the demolishees gives a brief overview to introduce the meaning and characteristics of housing demolition of the legal sense as the foundation, from the ownership, property rights, three aspects of the rights and interests of other rights are described the content of demolition, and from the current prominent contradictions are summarized by human rights protection units. The two is the emphasis on housing demolition demolition is exist to protect the rights of people , and analyzes the causes of these problems. From the demolition unit strong demolition assessment agencies, illegal assessment, violent demolitions have occurred when the author describes existing problems, from the definition of "public interest" fuzzy, lack of protection legislation, supervision and inspection and the lack of right relief is not in place and other aspects of interpretation legitimate rights and interests of the demolition is difficult to obtain effective protection. The three reason is to explore countermeasures to improve human rights protection by the demolition. From the improvement of legislative level, perfect law content and related procedures to start, focus on the legislation to perfect the dismantlees rights protection mechanism; to establish the classification of demolition system, clear public interest, improve the assessment mechanism and perfect the compensation mechanism, strengthen the housing security and other aspects as the main content, to further promote the implementation of housing demolition work legal compliance; proposals from strengthening supervision and restraint, enhance We should establish a sound supervision and inspection system in terms of supervision level, ensure the independence of supervision and so on. We should broaden the channels of mass supervision, improve judicial relief ways, crack down on illegal and criminal activities, and expand the way of remedies' rights relief.
