【摘要】:自2011年七省市建设碳排放权交易市场以来,相继公布了一系列碳排放权市场监管法律规范,促进了碳排放权交易市场的发展,也积攒了一些市场监管经验。在建设统一碳排放权交易市场的趋势下,我们必须要做好建立健全碳排放权交易市场监管法律制度的准备工作。分析我国碳排放权交易市场监管法律制度存在的问题是完善碳排放权交易市场监管法律制度的第一步;我国碳排放权交易市场监管不健全主要表现为具体监管制度,如监管体制、市场主体准入、信息披露、法律责任等规定不明确或者无规定所导致的监管无力、监管漏洞现象;究其根本,无相关立法以及现有法律规范效力层级低是最主要原因。对最大的强制碳交易市场——欧盟和最大的自愿碳交易市场——美国的立法状况、监管法律制度及实践操作进行研究,是完善我国碳排放权交易市场监管法律制度的第二步。经过比较,发现欧盟碳市场成功的原因除了坚定的碳减排信心,更重要的是欧盟形成了一套系统的、完善的、严密的监管法律制度。从国家体制和碳市场的发展状况来看,我国适合建立欧盟式的自上而下的统一监管体制,由中央主管机关负责碳市场的总体协调,省级碳交易主管机关在上级主管机关的领导下,负责本行政区的碳交易事务。市场监管发挥作用需要立法给予保证。目前我国要做的就是尽快颁布《碳排放权交易管理条例》,改变碳交易市场专项法律缺失的现状。同时为了解决法律操作性差的缺陷,需要制定相应的部门规章予以弥补。完善碳排放权交易市场监管法律制度体系,还需要设计具体的监管法律制度,在这个方面,欧盟同样能为我们提供更多有益的经验。因此,加快立法进程、设计具体有效的监管法律制度是完善我国碳排放权交易市场监管法律制度的第三步。
[Abstract]:Since 2011, seven provinces and cities have built carbon emission trading market, have published a series of carbon emission rights market regulatory legal norms, promote the development of carbon emissions trading market. It has also accumulated some experience in market regulation, in the light of the trend of building a unified carbon trading market. We must do a good job in establishing and perfecting the legal system of carbon emissions trading market supervision. Analysis of the existing problems of China's carbon emissions trading market regulatory legal system is to improve the carbon emissions trading market regulatory legal system. The first step of degree; China's carbon emissions trading market supervision is not perfect mainly for specific regulatory systems, such as regulatory system, market access, information disclosure, legal liability and other provisions caused by unclear or ineffective regulation. The phenomenon of supervision loophole; The main reason is the lack of relevant legislation and the low level of the existing legal norms. The largest mandatory carbon trading market-the European Union and the largest voluntary carbon trading market-the United States legislative situation. The study of regulatory legal system and practical operation is the second step to improve the regulatory legal system of carbon emissions trading market in China. After comparison, it is found that the success of EU carbon market is due to the firm confidence in carbon emission reduction. More importantly, the EU has formed a systematic, perfect, strict regulatory legal system. From the development of the national system and the carbon market, China is suitable for the establishment of the European Union-style top-down regulatory system. The central competent authority shall be responsible for the overall coordination of the carbon market, and the provincial competent authority for carbon trading shall be under the leadership of the competent authority at a higher level. Responsible for the carbon trading in our administrative region. The role of market supervision needs to be guaranteed by legislation. At present, what our country has to do is to promulgate the Regulation on carbon Emission Trading as soon as possible. At the same time, in order to solve the shortcomings of the poor operation of the law, it is necessary to formulate corresponding departmental regulations to make up for it, and to improve the regulatory legal system of carbon emissions trading market. There is also a need to design specific regulatory legal systems, in which the EU can also provide us with more useful experience... therefore, to speed up the legislative process. It is the third step to perfect the legal system of carbon emissions trading market to design specific and effective regulatory legal system.
