【摘要】:随着国际投资的多年实践,全球经济一体化趋势不断加强,贸易的自由化已经不能满足经济的发展,众多国家尤其是发达国家推行国际投资自由化。国际投资自由化要求国际投资能够自由进入投资东道国,不受或者尽量少受投资东道国的审查,投资者和投资能够在投资设业、运营、扩大、退出等各个环节得到非歧视待遇,要求外国投资能够得到东道国的高标准保护,要求东道国禁止对外国投资设定各种履行要求,要求在争端解决上能够跳开东道国当地救济而予以国际仲裁等等。经过40年改革开放,我国经济建设取得世界瞩目的成就。我国企业在发展壮大后走出国门,对外投资活跃,国家深入实施"走出去战略"。当前我国已成为世界名列前茅的对外投资大国,我国同时具有吸引外商投资和对外投资大国的双重身份,如何平衡这两种身份对国际投资自由化的不同要求,如何最大化地维护国家利益,是摆在我们面前的重大课题。我国应该深入研究投资自由化规则及其对我国经济的影响,根据我国经济在国际经济中所处的地位以及我国经济的发展现状,融入国际投资自由化趋势当中,积极参与国际投资规则的制定,积极开展双边投资协定谈判,为我国对外开放尤其是对外投资开创良好国际环境。同时,我国应当改革外商投资管理体制,制定统一的外国投资法,加大开放力度,全面实施准入前国民待遇;制定对外投资法,组建专门的对外投资监管机构,降低、放宽对外投资审批条件,支持、鼓励我国企业对外投资。
[Abstract]:With the practice of international investment for many years, the trend of global economic integration has been strengthened, and the liberalization of trade has not been able to meet the economic development. A large number of countries, especially developed countries, pursue international investment liberalization. International investment liberalization requires that international investment can enter the host country freely, without or as little as possible under the scrutiny of the host country. Investors and investments can receive non-discriminatory treatment in all aspects of investment, such as setting up, operating, expanding, withdrawing and so on, which requires foreign investment to be protected by the high standards of the host country. After 40 years of reform and opening up, the host country is required to prohibit the setting of various performance requirements for foreign investment, to be able to skip local relief from the host country and to be subject to international arbitration in dispute settlement. China's economic construction has made remarkable achievements in the world. At present, China has become one of the top foreign investment countries in the world. At the same time, China has the dual status of attracting foreign investment and foreign investment. How to balance these two identities on the different requirements of international investment liberalization, how to maximize the protection of national interests. China should deeply study the rules of investment liberalization and its impact on our economy, according to the status of our economy in the international economy and the development of our economy. In the trend of international investment liberalization, we should actively participate in the formulation of international investment rules, actively carry out bilateral investment agreement negotiations, and create a good international environment for China's opening up, especially foreign investment. At the same time. China should reform the foreign investment management system, formulate a unified foreign investment law, increase the degree of opening up, and fully implement the national treatment before admission; Formulate laws on foreign investment, set up special supervision agencies for foreign investment, reduce and relax the conditions for examination and approval of foreign investment, support and encourage Chinese enterprises to invest abroad.
