消费信息不对称法律规制研究

【摘要】:在现有的市场经济条件下,消费行为的发生是经济发展的前提及基础,而消费行为开始的前提是消费者能够对消费的客体有一定的认知,这就取决于消费者所能够获得的消费信息的数量及质量。但是,现实生活中由于消费信息不对称问题的存在,消费者的合法权益屡屡受到侵害,经营者也常常利用消费者的信息弱势地位获取非法利益。消费者能够掌握充分、有效的信息对消费者权益的保护具有基础性的作用,所以研究消费信息不对称及其带来负面影响,并分析其产生的原因,以期找到确实可行的解决路径,为消费者权益的保护提供理论上的支持就具有很重要的现实意义。 文章主要通过五个部分的内容对消费信息不对称进行研究分析:首先,以“消费信息不对称法律规制”为核心词,对消费信息不对称法律规制的相关概念加以界定,通过厘清消费信息不对称的法学原理及经济学原理,重点说明消费信息不对称法律规制的法理解析,明确消费信息不对称法律规制的变迁、定位及其特征;其次,对消费信息不对称及其法律规制做实然性分析,即在探讨我国消费信息不对称法律规制现状的基础上,综合分析消费信息不对称存在的问题、这些问题产生的原因以及消费信息不对称带来的危害;再次,通过分析欧美日等国家关于消费信息不对称的法律规制办法,结合我国的实践,找到对我国消费信息不对称法律规制有借鉴意义的法律规制方式;其四,在对消费信息不对称法律规制工具进行一般分析的基础上,分析一些可供选择的核心规制工具的运用及其他规制工具的特性;最后,结合前面所做的分析,以及我国现行法律体系中关于消费信息不对称规制的立法及执法情况,提出一系列具体的完善建议,以期为解决我国消费信息不对称问题提供一些理论帮助。
[Abstract]:In the current market economy, the occurrence of consumer behavior is the premise and foundation of economic development, and the premise of consumer behavior is that consumers can have a certain understanding of the object of consumption. This depends on the quantity and quality of consumer information that consumers can obtain. However, due to the existence of asymmetric consumer information in real life, the legitimate rights and interests of consumers are often infringed upon. Operators also often take advantage of consumers' weak position of information to obtain illegal interests. Consumers can master sufficient and effective information and play a fundamental role in protecting consumers' rights and interests. Therefore, it is of great practical significance to study the asymmetry of consumer information and its negative effects, and to analyze the causes of its emergence, in order to find a feasible solution and provide theoretical support for the protection of consumers' rights and interests. This paper mainly analyzes the asymmetry of consumer information through five parts: firstly, taking the "legal regulation of asymmetric consumer information" as the core word, it defines the related concepts of the legal regulation of asymmetric consumer information. By clarifying the legal and economic principles of asymmetric consumer information, this paper focuses on the legal analysis of the asymmetric legal regulation of consumer information, and clarifies the changes, positioning and characteristics of the legal regulation of asymmetric consumer information; secondly, On the basis of discussing the current situation of the legal regulation of the asymmetry of consumer information in our country, the paper comprehensively analyzes the problems existing in the asymmetry of consumer information, and makes a practical analysis of the asymmetry of consumption information and its legal regulation. The causes of these problems and the harm caused by the asymmetry of consumer information. Thirdly, through the analysis of the legal regulations on asymmetric consumer information in Europe, America, Japan and other countries, combined with the practice of our country, To find the legal regulation of asymmetric consumer information in China has reference significance of legal regulation; fourth, on the basis of the general analysis of the legal regulation tools of asymmetric consumer information, This paper analyzes the application of some core regulatory tools and the characteristics of other regulatory tools. Finally, combining with the previous analysis, and the legislation and enforcement of the asymmetric regulation of consumer information in the current legal system of our country, A series of concrete suggestions are put forward in order to provide some theoretical help to solve the problem of asymmetric consumption information in China.
