宏观调控行为的可诉性研究

【摘要】: 宏观调控越来越被重视,其在国家经济管理中也发挥着巨大的作用。但是同时,在我国宏观调控运行中慢慢地暴露出了目前存在的种种问题,其中最具有争议性的是宏观调控行为是否具有可诉性,这也是我国目前亟需解决的一个问题。 对宏观调控行为进行司法审查是必要的,是实现宏观调控目标的需要,是权力制衡的需要,是宏观调控法治化的需要,是宏观调控国际化的要求,且在对宏观调控行为进行司法审查时可利用司法权的特有功能。同时,从应然角度而言,对宏观调控行为进行司法审查是可行的:一是《宪法》第二条、第五条和第四十一条的规定为宏观调控行为接受司法审查提供了宪法依据,二是宏观调控行为不是国家行为,其不应被必然地排除在司法审查之外,三是通过司法体制改革可以使宏观调控行为具备诉的构成要件,四是由于只是对宏观调控行为的合法性进行司法审查,所以司法审查过程具有可操作性,五是对宏观调控行为进行司法审查有国际经验可借鉴。 但是,并不是所有的宏观调控行为都具有可诉性,可诉的宏观调控行为是分两个层次的:应诉且较易诉的宏观调控行为和应诉而难诉的宏观调控行为。 考虑实现宏观调控行为可诉的途径时,在借鉴他国经验的基础上必须得结合我国的国情。宏观调控具体执行行为可以通过传统的“三大诉讼”解决其可诉性,但在通过传统的“三大诉讼”对其进行司法审查时要考虑符合宏观调控行为特点的特殊规则。通过对违宪审查制度的构建,为对宏观调控决策行为和宏观调控抽象执行行为进行司法审查提供了可行的途径。同时,将公益诉讼制度和“法院之友”制度引入宏观调控诉讼中有着重大的意义。
[Abstract]:More and more attention has been paid to macro-control, which also plays a great role in the national economic management. But at the same time, in the operation of macro-control in our country, the existing problems have been gradually exposed. The most controversial issue is whether macro-control is actionable or not, which is an urgent problem in China. It is necessary to conduct judicial review of macro-control behavior, the need to achieve the goal of macro-control, the need for power checks and balances, the need for the legalization of macro-control, and the requirement for internationalization of macro-control. At the same time, it is feasible to carry on the judicial review to the macro-control behavior from the point of view of the ought to be: first, the second article of the Constitution, The provisions of articles 5th and 41th provide a constitutional basis for the acceptance of judicial review of macro-control acts. Second, macro-control acts are not acts of state, and they should not necessarily be excluded from judicial review. Third, through the reform of the judicial system, we can make the macro-control behavior have the constitutive elements of litigation, and fourth, because of the judicial review of the legitimacy of the macro-control behavior, the judicial review process has maneuverability. Fifth, there is international experience for the judicial review of macro-control behavior. However, not all macro-control behaviors are actionable, and the actionable macro-control behavior is divided into two levels: the appealable and easy to sue macro-control behavior and the justiciable macro-control behavior that is difficult to sue. When considering the way to realize the actionable behavior of macro-control, we must combine the national conditions of our country on the basis of drawing lessons from the experience of other countries. The concrete execution of macro-control can be solved by the traditional "three major litigation". However, the special rules which accord with the characteristics of macro-control should be taken into account in the judicial review through the traditional "three major litigation", and the constitution of the unconstitutional review system should be adopted. It provides a feasible way for judicial review of macro-control decision-making behavior and macro-control abstract executive behavior. At the same time, it is of great significance to introduce public interest litigation system and "amicus curiae" system into macro-control litigation.
