我国多式联运立法模式研究

【摘要】:多式联运作为一种高级运输组织形式,能够大大提高运输效率,降低运输成本,减少货损货差。随着集装箱运输和现代物流的蓬勃发展,多式联运也在运输中占据了相当的规模,且在不断地扩张中。在多式联运实践迅速发展的过程中,对法律保障的需求也在加深。然而,我国目前在多式联运立法上却呈现出较为滞后的态势,规定零散且存在相当的制度空白,缺乏对多式联运法律制度统一而协调的法律规范或规范体系。本文在分析我国多式联运立法现状和相关学界观点的基础之上,考察相关的国外立法例,探讨我国多式联运在立法模式上的选择,试图寻找满足我国多式联运发展实践需要且符合我国立法传统和技术习惯的立法模式。全文共分为五个部分:第一部分对多式联运的表述和内涵,立法模式的基本概念、构成、属性及变量进行阐释,将本文所讨论的立法模式概念限定在狭义范畴,并对多式联运立法模式的概念及构成作出了基本界定;第二部分评析了我国多式联运立法现状,指出我国现有多式联运立法模式在外在形式和制度构成上的缺陷,讨论造成这种缺陷的原因,在此基础上评析学界对多式联运立法模式所提出的各种观点;第三部分梳理了国外现有多式联运立法例,并进行分析和比较,考察对我国多式联运立法模式构建的可借鉴之处;第四部分分析了我国多式联运立法模式选择的考量因素,对我国多式联运立法模式的选择作出判断,并阐释其原因和可行性;最后一部分针对我国多式联运立法模式的制度构建提出了一点建议,分别从多式联运立法模式的价值目标、性质定位、框架构成以及外部衔接四个方面进行阐述。
[Abstract]:Multimodal transport, as a form of advanced transport organization, can greatly improve transport efficiency, reduce transport costs and reduce cargo damage. With the rapid development of container transportation and modern logistics, Multimodal transport also occupies a considerable scale in transportation, and is constantly expanding. In the process of rapid development of multimodal transport practice, the demand for legal protection is also deepening. However, At present, the legislation on multimodal transport in our country is lagging behind, and the regulations are scattered and there is a considerable gap in the system. There is a lack of unified and coordinated legal norms or normative system for multimodal transport. Based on the analysis of the current situation of multimodal transport legislation in China and the views of relevant academic circles, this paper investigates the relevant foreign legislative examples. This paper discusses the choice of legislative mode of multimodal transport in China. The thesis is divided into five parts: the first part is the expression and connotation of multimodal transport, the basic concept of legislative model, and the composition of the legislative model. Attribute and variable are explained, the concept of legislative model discussed in this paper is limited to the narrow scope, and the concept and composition of multimodal transport legislative model are basically defined. The second part analyzes the current situation of legislation on multimodal transport in China. This paper points out the defects in the external form and system constitution of the current legislative model of multimodal transport in our country, discusses the causes of this defect, and comments on the various viewpoints put forward by the academic circles on the legislative model of multimodal transport. The third part combs the foreign existing multimodal transport legislation example, and carries on the analysis and the comparison, inspects to our country multimodal transport legislation pattern construction may draw lessons from the place; 4th part has analyzed our country multimodal transport legislation pattern choice consideration factor, This paper makes a judgment on the choice of the legislative mode of multimodal transport in our country, and explains its reasons and feasibility. In the last part, it puts forward some suggestions for the system construction of the legislative mode of multimodal transport in our country, respectively from the value target of the legislative mode of multimodal transport. The nature of the positioning, framework composition and external cohesion four aspects to elaborate.
