全球控烟背景下中国烟草管制法律制度研究

【摘要】：烟草行业对我国的经济具重要的作用,但随着科技的发展和人们对自身健康的重视,烟草产品对健康的毒害作用也越来越为人们所认知和接受。很多国家和地区已经开始通过法律对烟草的生产和消费进行限制。从世界范围看,对烟草企业生产、销售以及烟草产品的消费进行更加严格的管理和控制已是大势所趋。自我国加入《烟草控制框架公约》,对烟草产业及产品实施更为严厉的管制法律制度已经势在必行。本文采用比较分析、文献分析等研究方法,以烟草的管制法律为切入点,在结构上分为三部分。第一部分介绍了欧美及日本等发达国家烟草管制的立法现状与实践,通过对比欧美日发达国家与我国烟草管制立法的不同,阐述了全球控烟文明的发展以及中外烟草管制的历史进程。第二部分通过对我国烟草产品在生产、销售以及消费中存在的问题进行分析,从烟草产品生命周期的具体环节中追根溯源,系统分析我国烟草管制制度在税收及私权利等方面的缺陷,总结出我国烟草管制制度中的不足。第三部分则针对第二部分中存在的问题,结合先进国家经验以及我国烟草行业现状,从健全法制,统一法规以及加强烟草消费监督三方面入手,提出完善我国烟草管制法律的合理建议。
[Abstract]:Tobacco industry plays an important role in China's economy, but with the development of science and technology and people attach importance to their own health, The toxic effect of tobacco products on health is increasingly recognized and accepted by people. Many countries and regions have begun to restrict the production and consumption of tobacco through laws. Since our country joined the Framework Convention on Tobacco Control, a more stringent legal system has been applied to the tobacco industry and products. This paper uses comparative analysis, Literature analysis and other research methods, with the tobacco control law as the breakthrough point, the structure is divided into three parts. The first part introduces the current situation and practice of tobacco control legislation in developed countries, such as Europe, America and Japan. By comparing the differences between the developed countries in Europe, America and Japan and the legislation of tobacco control in China, the paper expounds the development of global tobacco control civilization and the historical process of tobacco control at home and abroad. The second part is about the production of tobacco products in China. The problems existing in sales and consumption are analyzed to trace back to the source of the specific links of the life cycle of tobacco products, and the defects of the tobacco control system in tax and private rights in China are systematically analyzed. The third part aims at the problems existing in the second part, combining the experience of advanced countries and the current situation of tobacco industry in our country, from perfecting the legal system, This paper puts forward some reasonable suggestions on how to perfect the tobacco control laws of our country by unifying the laws and regulations and strengthening the supervision of tobacco consumption.
