金融消费者知情权的法律保护研究

【摘要】:随着经济的发展,人们愈来愈不仅仅满足于过去的消费需求,在金融产品和金融服务越来越丰富的这个契机之下,,消费者为了满足自身愈加多样化的消费需求,也开始逐步的进入金融市场。而相对于传统的消费活动来说,金融消费的层次和水平显然更高。由于金融机构提供的金融产品和金融服务的复杂性、专业性,使得金融消费者与传统消费者相比,更加处于劣势地位。而交易双方信息的不对称、不平等更是如此,对金融消费者利益的侵害也是屡有发生。但是,通过国外金融危机的经验教训,我们不难发现,金融消费者知情权的保护在整个金融业的发展中都处于核心地位。唯有消费者的知情权获得了更为有力的保障,才能使得金融市场健康成长。可见,在法律上保障金融消费者知情权更加具有紧迫性和务必性。 在我们国家,因消费者知情权受到侵害而引发的纠纷也有很多,这就是我们国家在保障金融消费者知情权时还有着很多不足之处的表现。主要表现在:相关的立法不够完善,还存在着很大的缺陷;监管方式单一,金融交易规范不完善;还未建立专门的机构对金融消费者进行统一的保护;救济措施混乱、可操作性差等。 要强化保障金融消费者知情权的力度,首先要在法律中明确金融消费者及其知情权的概念与外延,其次要加强监管体制的建设,对金融交易规范做进一步的完善;再次要建立一个具有可操作性的专门机构;最后就是加大对金融消费者知情权的权利救济力度,可以分别从行政救济和司法救济两个方面入手,尤其是要建立举证责任倒置的制度以及完善小额诉讼制度。以上这些手段都有利于我们逐步建立一个具备我国特色的金融消费者权益保护体制,实实在在的维护好金融消费者的权益,尤其是其知情权,使得我国的金融行业可以更快、更好的发展。
[Abstract]:With the development of economy, people are more and more satisfied with the consumption demand in the past. Under the opportunity of more and more abundant financial products and services, in order to satisfy their more diversified consumer demand, And the level and level of financial consumption is obviously higher than that of traditional consumption activities. Because of the complexity and professionalism of the financial products and services provided by financial institutions, Financial consumers are in a more disadvantaged position than traditional consumers. The asymmetry and inequality of information between the two sides of the transaction is even more so, and the infringement on the interests of financial consumers also occurs repeatedly. However, Through the experience and lessons of the foreign financial crisis, it is not difficult to find out that the protection of the right to know of financial consumers is at the core of the development of the financial industry as a whole. It can make the financial market grow healthily. It can be seen that it is more urgent and necessary to protect the financial consumers' right to know in law. In our country, there are also many disputes caused by the infringement of consumers' right to know, which is that our country still has many inadequacies in protecting the right of financial consumers to know. The main manifestations are: the relevant legislation is not perfect enough. There are also a lot of defects; single regulatory mode, financial transaction norms are not perfect; has not yet established a special organization to protect financial consumers unified; relief measures are chaotic, poor operability, and so on. In order to strengthen the protection of financial consumers' right to know, first of all, the concept and extension of financial consumers and their right to know should be clearly defined in the law; secondly, the construction of supervision system should be strengthened, and the financial transaction standard should be further improved. Once again, it is necessary to establish an operational specialized organization; finally, to increase the right to relief to financial consumers' right to know, we can start from two aspects, administrative relief and judicial relief, respectively. In particular, it is necessary to establish a system of inversion of the burden of proof and to improve the system of small claims. All of these measures are conducive to the gradual establishment of a financial consumer rights and interests protection system with Chinese characteristics. Protecting the rights and interests of financial consumers, especially their right to know, makes the financial industry of our country develop faster and better.
