【摘要】：不可抗辩制度起源于欧美国家,是用以维护投保人及被保险人的权益、对保险人的合同解除权进行严格限制。在我国民众观念中,保险行业信用度一直不高,经常出现一些“保险容易、理赔难”的问题。引入不可抗辩制度,为改善保险行业的信誉度起到了积极作用。我国2009年《保险法》中正式将不可抗辩制度引入,以求保护投保人或被保险人的合法利益,限制保险人的合同解除权。在具体实施过程中,不可抗辩制度存在相关问题,法律法规不完备、监督体系不健全、辅助制度不完善等问题。本文大体分为四个部分。第一部分为不可抗辩的历史沿革及立法规定;第二部分为我国不可抗辩制度的发展与内容解析;第三部分为我国不可抗辩条款的适用及缺陷;第四部分为关于完善我国不可抗辩制度的对策建议。本文通过对不可抗辩条款进行学理性研究与实践研究相结合,运用保险学、法学、历史学等相关学科进行研究分析。通过梳理不可抗辩制度的历史发展及其他国家和地区的规定与先进经验,阐述不可抗辩制度在我国的发展现状,探讨我国在不可抗辩制度中存在的问题与弊端,用以提出合理性建议。
[Abstract]:The non-defensible system originates from European and American countries. It is used to protect the rights and interests of the insured and the insured, and to restrict strictly the right of the insurer to terminate the contract. In the public opinion of our country, the credit of the insurance industry is not high all the time. There are often some problems such as "easy insurance, difficult claims". The introduction of the non-defense system has played a positive role in improving the reputation of the insurance industry. In 2009, China's Insurance Law formally introduced the non-defensible system. In order to protect the legitimate interests of the policyholder or the insured, limit the insurer's right to terminate the contract. In the concrete implementation process, there are some problems in the system of non-defense, the laws and regulations are not complete, the supervision system is not perfect, This paper is divided into four parts: the first part is the history of the indefensible system and the legislative provisions, the second part is the development and content analysis of the indefensible system in our country. The third part is the application and defect of the indefensible clause in our country, and the 4th part is about the countermeasure and suggestion to perfect the indefensible system in our country. By combing the historical development of the irrefutable system and the regulations and advanced experiences of other countries and regions, this paper expounds the current situation of the development of the non-defensible system in China. This paper discusses the problems and drawbacks in the system of indefensible defense in our country, and puts forward some reasonable suggestions.
