【摘要】:任何竞争都发生在一定范围的市场中。判断企业的行为是否阻碍了竞争,首先要明确市场范围,这些市场就构成了相关市场。一直以来,相关市场都是反垄断法领域研究的重点课题。在大多数反垄断案件中,界定相关市场都是最基础的工作,是评估企业市场力、计算市场份额的前提,尤其是在滥用市场支配地位和经营者集中审查中,科学、准确地界定相关市场范围,对企业的意义更为重大。近年来,互联网行业呈现高速发展的势态,深刻地影响着人们的工作和生活。同时,这种跨越式的发展也导致了竞争的加剧,互联网行业反垄断案不断涌现。在互联网反垄断中,相关市场的界定仍是竞争分析的起点。然而,互联网行业在发展过程中形成了网络外部性、双边市场等很多独特的特征,而且互联网市场与传统市场之间存在很多差异性,导致了在界定互联网行业相关市场时,传统的界定方法面临着不同程度的局限性。本文首先以传统相关市场界定的理论为基础,阐述了相关市场界定的一般方法;继而结合互联网行业的特征,分析传统方法在界定互联网行业相关市场时的局限性;最后通过借鉴美、欧等国家的经验,提出一系列完善互联网行业相关市场界定的建议。本文分为以下四个部分:第一部分,探讨相关市场的基本理论,包括相关市场的概念、构成以及相关市场界定的三种基本方法,并分析相关市场界定在反垄断中作用,为互联网行业相关市场界定奠定了理论基础。第二部分,阐述互联网行业的特征,对比分析互联网市场与传统市场的差异性,结合当前的司法实践指出传统方法在界定互联网行业相关市场时存在的问题。第三部分,介绍美国、欧盟界定互联网行业相关市场的司法判例,分析这些国家界定产品市场和地域市场的方法和思路,通过对这些案例的分析从中总结出对我国互联网行业相关市场界定有益的经验和启示。第四部分,结合前文所述,在总结问题和借鉴经验的基础上,从立法与司法两个层面提出完善互联网行业相关市场界定的建议。

The fourth part, combined with the above, on the basis of summarize the problem and experience on the Internet industry to improve the definition of the relevant market recommendations from two aspects of legislation and judicature.
