【摘要】：我国农村小额信贷规模逐步壮大,在我国农村小额信贷市场需求日益增长的情况下,法律制度瓶颈已严重制约了我们农村小额信贷的发展。农村小额信贷得到国家专门法律的保护就显得尤为重要。因此,我国农村小额信贷法律制度亟须重构。我国农村小额信贷的现有法律制度并不能很好的规制与保障农村小额信贷的健康稳步发展,出现实践与立法相脱节的种种问题。本文通过探讨我国农村小额信贷的法律制度现状及存在的法律困境,针对目前法律制度中存在的束缚提出法律对策并拟建立完善的法律制度。本文从法律角度对农村小额信贷所面临的法律困境,如法律地位不明确、运作体制、监管欠缺等问题进行分析,并对国外农村小额信贷法律制度进行比较研究,提出完善相应的法律制度来促进农村小额信贷的发展,从而使农村小额信贷能顺利并持续稳定的健康发展。这对于农村小额信贷的发展具有极其重要的意义。
[Abstract]:The scale of micro-credit in rural areas in our country is gradually growing, and with the increasing demand of the rural micro-credit market in our country, The bottleneck of the legal system has seriously restricted the development of our rural micro-credit. It is particularly important that the rural micro-credit is protected by the special law of the state. It is urgent to reconstruct the legal system of rural micro-credit in our country. The existing legal system of rural micro-credit in our country is not able to regulate and ensure the healthy and steady development of rural micro-credit. This paper discusses the current situation of the legal system of rural microfinance in China and the existing legal dilemma. In view of the restraint existing in the current legal system, the author puts forward the legal countermeasures and proposes to establish a perfect legal system. This paper, from the legal point of view, deals with the legal difficulties faced by rural microfinance, such as the unclear legal status, the operating system, The problems such as lack of supervision are analyzed, and a comparative study is made on the legal system of rural micro-credit in foreign countries, and the corresponding legal system is proposed to promote the development of rural micro-credit. It is of great significance for the development of rural microfinance to make the rural microfinance develop smoothly and steadily.
