中资银行海外经营的法律风险及其对策研究

【摘要】：为了服务中国企业走出去、参与国际金融行业竞争以及人民币国际化等战略,中资银行需要不断拓展海外业务,通过参与市场竞争,提升国际化经营的水平,服务国家战略发展目标。然而,由于一系列原因,中资银行在海外的拓展并非一帆风顺,正在面临"成长的烦恼"。如何应对海外经营所面临的法律风险,提高风险防范意识,并进行有效的风险预防,除了应熟悉当地法律,依法进行合规经营,科学、高效地治理公司等内因尚需不断改进。中资企业海外经营会面临诸多风险,文中重点以中资国有银行在美国遭遇的各种法律诉讼困境为研究对象,力求为中资银行"走出去"提供一些有针对性的法律风险防范对策。
[Abstract]:In order to serve Chinese enterprises to go out, participate in international financial industry competition and internationalization of the RMB, Chinese banks need to continuously expand their overseas business, by participating in market competition, to raise the level of international operation. However, due to a series of reasons, the expansion of Chinese banks overseas is not plain sailing, and they are facing "growing pains". How to deal with the legal risks faced by overseas operations and raise their awareness of risk prevention, And effective risk prevention, in addition to being familiar with local laws, conducting compliance operations according to law, scientific and efficient management of companies, and other internal causes still need to be continuously improved. Chinese-funded enterprises will face many risks. This paper focuses on the various legal difficulties encountered by Chinese state-owned banks in the United States as the research object, and tries to provide some targeted legal risk prevention countermeasures for the Chinese banks to "go out".
