我国保障性住房法律问题研究

【摘要】：“住房权”是公民“生存权”的重要内容之一,是公民生存所必备的、最基本的人权。为了最大限度、最充分地保障公民的居住权,世界各国都相继建立了完善的保障性住房制度,并多以立法的形式予以确定。为了实现公民的“居住梦”,我国政府相继出台了经济适用房制度、廉租房制度等住房保障政策,这在一定程度上缓解了住房矛盾,保障了公民的居住权。但是由于经济、政治等多方面的原因,我国尚未建立完善的保障性住房制度体系,亦无关于保障性住房的统一立法。我国在保障性住房发展中出现了准入及退出机制不健全、政府职能缺失、监管机制不健全等问题。笔者在对域外相关保障性住房制度进行介绍与借鉴的基础上,试图从制定住房保障法、完善保障性住房法律制度、明确保障性住房准入及退出机制、强化政府职能、建立健全保障性住房监督机制四方面完善我国保障性住房制度。
[Abstract]:"the right to housing" is one of the most important contents of the citizen's "right of existence", and it is the most basic human right necessary for the citizen's survival. Every country in the world has set up a perfect indemnificatory housing system one after another, and it has been determined by legislation. In order to realize citizens'"residence dream", our government has successively issued housing security policies such as comfortable housing system, low-rent housing system, etc. To a certain extent, this alleviates the housing contradiction and protects citizens' right of abode. However, due to various economic and political reasons, our country has not yet established a sound system of affordable housing system. It has nothing to do with the unified legislation of affordable housing. In the development of affordable housing, there is an imperfect access and exit mechanism and a lack of government functions in our country. On the basis of introducing and drawing lessons from the relevant indemnificatory housing system outside the country, the author tries to establish the housing security law, perfect the legal system of the indemnificatory housing, and clarify the admittance and withdrawal mechanism of the indemnificatory housing. Strengthen the function of government, establish and perfect the supervision mechanism of indemnificatory housing, perfect our country's indemnificatory housing system in four aspects.
