倒按揭贷款养老中抵押借贷法律关系研究

【摘要】：据资料显示,人口老龄化的硝烟已经早早的弥漫全球,任何一个国家都将不可回避的面对人口老龄化问题；作为世界上经济转型极为迅速的发展中国家,早年的生育高峰带来的问题到现在已经尖锐的凸显出来。目前,我国已经很确定的走入了老龄化社会,成为世界上老年人口最多、并且增长速度最快的国家。在这样的一大背景下,不得不敦促我们寻求新的多样化的养老方式,作为传统的中国人,从步入社会开始就计划用自己的劳动打造自己的房子,到了老年自己早年打下的“江山”便是最好的养老依靠。而在国外,倒按揭贷款养老早年都受到了极大的关注,并且拥有丰富的失败教训和成功的经验,为养老问题的解决及金融市场的活跃做出了不可磨灭的贡献。法律制度的国际化及立法理念的交融贯通给予了倒按揭制度以国际发展背景。因此,在我国追求倒按揭贷款养老的发展已经具有了极大的可行性。论文着重从法律关系入手,细致探析倒按揭贷款养老中存在的主要法律关系。全文分为四大部分,第一部分从倒按揭贷款养老的概念入手,分析出倒按揭贷款养老制度存在的基本法律关系,并且将各法律关系之间的位阶给予区分。第二部分主要介绍倒按揭贷款养老中的主法律关系即抵押借贷法律关系的主体,在立足我国实际的基础上,借鉴国外经验,给予法律关系中的主体一个明确的界定。第三部分主要介绍主法律关系中的客体,即倒按揭运行中存在的各种形态的标的物,为下文倒按揭制度的建立奠定基础。第四部分主要介绍倒按揭贷款养老中主法律关系的内容,即权利和义务,明确双方当事人的具体权利义务是理清一项法律关系的重点,这部分也将成为全文的重点部分。
[Abstract]:According to the data, the smoke of the aging population has spread all over the world early. Any country will inevitably face the problem of population aging. As a developing country with an extremely rapid economic transition in the world, The problems brought about by the birth boom in the early years have been acutely highlighted. At present, our country has definitely entered an aging society, becoming the largest number of elderly people in the world. And the fastest-growing countries. Against this backdrop, we have to urge us to seek new and diversified ways of providing for the aged. As traditional Chinese, they plan to build their own houses with their own labor from the beginning of their social life. In the early years of old age they lay down the "Jiangshan" is the best old-age support. In foreign countries, in the early years of the old age pension, the reverse mortgage loan has received great attention, and has a wealth of failure lessons and successful experience. It has made an indelible contribution to the solution of the pension problem and the active financial market. The internationalization of the legal system and the blending of legislative ideas have given the international development background to the reverse mortgage system. In China, the pursuit of the development of reverse mortgage loans for the aged has had a great feasibility. The thesis focuses on the legal relationship, and analyzes the main legal relationship in the pension of the reverse mortgage loan. The paper is divided into four parts. The first part begins with the concept of the pension of the reverse mortgage loan. This paper analyzes the basic legal relationship of the pension system of the reverse mortgage loan, and distinguishes the rank among the legal relations. The second part mainly introduces the principal legal relationship in the pension system of the reverse mortgage loan, that is, the subject of the legal relationship of mortgage loan. Based on the reality of our country, drawing lessons from foreign experience, giving a clear definition of the subject in the legal relationship. The third part mainly introduces the object of the subject legal relationship, that is, the subject matter of various forms existing in the operation of reverse mortgage. The 4th part mainly introduces the content of the main legal relationship in the pension of the inverted mortgage loan, that is, the rights and obligations, and clarifies the specific rights and obligations of both parties is the key to clarify a legal relationship.
