【摘要】：公路行政执法是公路行政管理的不可或缺的组成部分,也是我国推行依法行政的重要环节,其高效开展能够明晰执法主体和客体的权利与义务,进而有利于保障我国公路的畅通以及规范、安全使用。行政执法部门与执法人员开展公路行政执法的主要依据是《公路法》的相关条例,主要政策基础为国务院《全面推进依法行政实施纲要》中对行政执法的要求,其目的在于通过对执法效率及管理效益的提升,全面、准确地贯彻和执行路政执法工作,进而使得正常的公路交通秩序得到保障和维护。公路行政执法是公路行政管理的不可或缺的组成部分,而公路行政管理又是政府行政权力在公路社会关系这一特殊载体中的有效拓展和具体表现形式,因此对于公路路政执法的研究有其必要性。基于此,本文在大量学习研究的基础上,就甘肃省农村公路路政执法中存在的有关问题进行了研究、探索和分析：首先,对国内外关于农村公路路政执法方面的文献进行了梳理和归纳；其次,对公路行政执法的涵义进行清晰的界定,并介绍其特征,同时指出公路行政执法的理论依据；再次,对甘肃省农村公路路政执法的现状进行描述并从主体、制度等方面入手,对存在的问题进行分析;然后,通过集中对国外比较成功的公路执法实践模式的介绍,总结出对我国公路路政执法工作的启示,为下一步的对策建议做准备；最后,根据上文的分析,结合甘肃省的实际情况,提出完善甘肃省农村公路路政执法工作的对策建议。本文的研究思路对于完善甘肃省农村公路路政执法工作有很好的借鉴作用。
[Abstract]:Highway administrative law enforcement is an indispensable part of highway administration, and also an important link in the implementation of law administration in our country. Its efficient development can clarify the rights and obligations of the subject and object of law enforcement. The main basis for administrative law enforcement departments and law enforcement personnel to carry out highway administrative law enforcement is the relevant regulations of the Highway Law. The main policy basis is the requirements for administrative law enforcement in the State Council's outline for the Comprehensive Promotion of Administration according to Law. Its purpose is to comprehensively and accurately carry out and implement the road administration law enforcement work through improving the efficiency and management effectiveness of law enforcement. Thus, normal highway traffic order is guaranteed and maintained. Highway administrative law enforcement is an indispensable part of highway administration. Highway administration is the effective expansion and concrete form of government administrative power in the special carrier of highway social relations. Therefore, it is necessary to study the law enforcement of highway administration. On the basis of a great deal of study and research, this paper studies the problems existing in the law enforcement of rural highway administration in Gansu province, explores and analyzes: firstly, the literature on rural highway administration law enforcement at home and abroad is sorted out and summarized; Secondly, the meaning of highway administrative law enforcement is clearly defined, and its characteristics are introduced. At the same time, the theoretical basis of highway administrative law enforcement is pointed out. Thirdly, the present situation of rural highway administration law enforcement in Gansu province is described and the main body is introduced. Then, through the introduction of the successful road law enforcement practice mode abroad, summarizes the enlightenment to the highway administration law enforcement work of our country, and makes the preparation for the next step countermeasure suggestion, the system and so on aspect, carries on the analysis to the existence question; Finally, according to the above analysis, combined with the actual situation in Gansu Province, The paper puts forward the countermeasures and suggestions to perfect the law enforcement of rural highway administration in Gansu province. The research ideas of this paper have a good reference function for perfecting the law enforcement work of rural highway administration in Gansu province.
