网络交易不正当信用评价行为法律规制研究

【摘要】:随着互联网技术的飞速发展,网络购物以其便利快捷、价格优惠、品类齐全等优势,快速发展成为互联网时代中极为重要的新型交易模式。但是,网络交易方便大众的同时也存在着许多问题。因为网络交易特有的虚拟性,网络交易消费者在面对同种类商品时,判断和评价商品的好坏很大程度上依赖网络交易经营者对商品的介绍以及其他网络交易消费者在完成交易后所提供的评价。其中,网络交易经营者在经营过程中所累积的信用评价,对于网络交易消费者来说是最为重要的参考依据。由此,一些不法经营者为了获得更高的成交量,牟取更多的利润,选择利用好评返现、刷信誉、恶意差评、强迫删除中差评等手段,提高自身的信用评价,以此诱导其他网络交易消费者与之进行交易。以上所列举的不正当获取信用评价的行为对网络交易消费者的知情权、隐私权造成了严重的损害,也因为作出虚假宣传和商业诋毁的网络交易不正当信用评价行为,使其他诚信经营的同业竞争者丧失交易机会,损害了网络交易平台的经济利益,扰乱公平竞争的网络交易秩序。然而,我国目前有关网络交易方面的法律法规还不全面,针对网络交易不正当信用评价行为的法律规制更是不完善。对于网络交易消费者来说,按照我国现有法律规定,在通过司法途径进行维权时,关于管辖法院、电子证据取证、举证责任分配都会陷入不利地位。对于作出不正当网络交易信用评价行为的网络交易经营者的执法监管方面,行政执法权限模糊、行政执法效能低下都是较为突出的问题。另外,对于网络交易平台的自我管理也缺乏明确的法律地位和法律义务,导致许多网络交易平台提供者对网络交易不正当信用评价行为持纵容态度。因此,本文结合我国法律规制现状,借鉴域外法律规制经验,针对目前法律规制中的具体问题,为我国完善网络交易不正当信用评价行为的法律规制提出建议。本文除引言和结语外分为四部分:文中的第一部分是对网络交易中获取不正当信用评价的行为进行了介绍。首先介绍的是网络交易信用评价的相关概念,然后对网络交易不正当信用评价行为作出法律认定。介绍了现阶段网络交易不正当信用评价行为主要体现在好评返现、刷信誉、恶意差评和网络交易经营者强迫网络交易消费者删除中差评等不良现象。种种不正当信用评价行为严重侵害了网络交易消费者的知情权和隐私权,也抢占了同业竞争者的交易机会,同时对网络交易平台提供者的商誉和网络交易正常秩序也带来了极大的损害。第二部分首先阐述的是当下国内对网络交易不正当信用评价行为的法律规制情况,接下来在网络交易消费者受到网络交易不正当信用评价行为侵害时维权难、对进行网络交易不正当信用评价行为的经营者监管弱以及网络交易平台提供者纵容网络交易不正当信用评价行为三个方面,阐释我国目前对网络交易不正当信用评价法律规制存在的不足。第三部分为域外对网络交易不正当信用评价行为的法制经验及借鉴。通过了解德国、美国、欧盟、日本以及韩国现有的法律规制经验,对完善我国网络交易不正当信用评价行为的法律规制提供经验借鉴。第四部分是对我国完善网络交易不正当信用评价行为法律规制提出的建议。针对网络交易中如何优化网络交易消费者的维权制度、如何完善网络交易经营者的监管制度以及如何健全网络交易市场内部的管理制度三个角度进行分析。
[Abstract]:With the rapid development of Internet technology, online shopping with its convenient, price concessions, complete category and other advantages, rapid development becomes an extremely important new trading mode in Internet era. However, the network transaction convenience of the public at the same time there are also many problems. Because the virtual network transaction is unique, consumers in the face of the same types of goods, evaluation judgment and evaluation of the quality of the commodity trading network operators rely heavily on the product description and other online trading consumer that after the completion of the transaction. The credit evaluation of network exchange operator, accumulated in the course of business, for consumers is the most important reference for this. Some unscrupulous operators, in order to obtain a higher volume, making more profits, choose to use praise back now, brush reputation, malicious bad review, Force rating means poor delete, improve the credit evaluation of their own, in order to induce other consumers with transactions. The above list improper access to credit evaluation of the behavior of the network trade consumer's right to know, the right of privacy has caused serious damage, but also because of the trade of the network to make false propaganda and commercial defamation not just as the credit evaluation of credit management behavior, make other competitors lose trading opportunities, damage the network trading platform of economic interests, disrupt the fair competition order of online trading. However, China's current relevant laws and regulations of network transactions is not comprehensive, the legal regulation for online transactions unfair credit evaluation behavior is not perfect. For consumers, in accordance with the provisions of the existing law of our country, the rights through judicial means, on the jurisdiction of the court, electronic evidence The evidence, the distribution of the burden of proof will be in a disadvantageous position. For the law enforcement supervision made unfair credit evaluation network behavior in the network transaction operator, the administrative law enforcement authority is fuzzy, low efficiency of administrative law enforcement is a prominent problem. In addition, the lack of legal status and legal obligation for a clear self management network trading platform that caused a lot of online trading platform provider of network transactions unfair credit evaluation behavior connivance. Therefore, this paper combined with the status quo of China's legal regulation, from the extraterritorial legal regulation of experience, for the specific issues in the legislation, put forward suggestions for the improvement of the legal regulation of network transactions unfair credit evaluation behavior in our country. In addition to this the introduction and conclusion is divided into four parts: in the first part of this paper is to obtain unfair credit evaluation behavior in network transactions are introduced. At first introduced the concept of network credit evaluation, then the network transaction unfair credit evaluation behavior to make legal identification. We introduce the network transaction unfair credit evaluation behavior is mainly reflected in the praise back now, brush reputation, malicious bad transactions and network operators forced the network transaction poor rating delete bad phenomenon consumers. Various unfair credit evaluation behavior is a serious infringement of the right of privacy and right to know consumers, but also to seize the competitors trading opportunities, while the normal order of goodwill and network transactions on the Internet trading platform provider has also brought great damage. The second part is the legal regulation of the current domestic transactions on the network unfair credit evaluation behavior, followed by the network transaction unfair credit evaluation behavior infringed in the online trading consumer dimension Right to conduct online transactions, the unfair credit evaluation behavior and weak business network trading platform provider to network transactions unfair credit evaluation behavior in three aspects, explain China's current network of improper transactions are legal regulation of credit evaluation. The third part is the extraterritorial legal experience of Internet unfair credit behavior evaluation and reference. Through the understanding of the United States, Germany, the EU, Japan and South Korea the existing legal regulation, perfecting legal system of our country network transactions unfair credit evaluation behavior to provide experience for reference. The fourth part is to improve the present legal regulation of network transaction unfair credit evaluation behavior. According to the suggestions on how to optimize the network the transaction system of consumer rights in network transactions, how to improve the network exchange operator supervision system and how to improve the network transaction The management system within the market is analyzed in three angles.
