资源配置市场化改革的法律边界与制度抉择——基于经济法视角的分析

【摘要】：党的十八届三中全会启动了全面深化改革的伟大议程,为经济体制改革中的资源配置方式改革设定了总目标,以此为依据,政党政治引领下的资源配置市场化改革经由个案性的试点实践上升为规范性的行动纲领。改革规划为经济法的进一步成长提供了宝贵的历史契机,并赋予了后者在资源配置法治化进程中的崭新历史使命,而航班时刻配置的改革试点实践为厘定经济法在资源配置市场化进程中的法律边界也提供了实证样本。在此基础之上,经济法应当设计出匹配资源配置市场化改革的制度安排,以期在确认改革成果的基础之上,力争以规划改革方向为更高价值取向。
[Abstract]:The third Plenary session of the 18th CPC Central Committee launched the great agenda of comprehensively deepening reform and set a general goal for the reform of the pattern of resource allocation in the reform of the economic system. The market-oriented reform of resource allocation under the guidance of political party politics has been transformed into a normative action program through individual pilot practice. The reform plan provides a valuable historical opportunity for the further development of economic law, and endows the latter with a new historical mission in the process of legalizing the allocation of resources. The pilot practice of flight time allocation provides an empirical sample for determining the legal boundary of economic law in the process of marketization of resource allocation. On this basis, the economic law should design the system arrangement to match the market-oriented reform of the allocation of resources, in the hope that, on the basis of confirming the achievements of the reform, the direction of planning and reform should be regarded as a higher value orientation.
