第三方支付中的消费者权益保护问题研究

【摘要】:第三方支付伴随着网络交易而迅猛发展,因其便利性、经济性的特点,受到广大消费者的青睐。但是其过快的发展速度也带来了一系列问题,其中消费者权益保护问题最为突出。因第三方支付高度虚拟性、专业性、技术性的特征,使得第三方支付中的消费者处于弱势地位,其风险防范能力比一般消费者更弱。并且我国在第三方支付领域的立法明显滞后,对于第三方支付中消费者权益保护方面的规定十分零散且存在缺陷,对消费者的个人信息安全、资金安全、知情权等都缺乏适当保护。消费者权益保护是第三方支付行业健康发展的中心环节,落实消费者权益保护,才能保障第三方支付行业的长远发展。本文通过分析第三方支付与消费者之间的基础关系,进而结合实践中消费者权益受损的案例,深入探讨我国在第三方支付消费者权益保护方面存在的法律问题,接着从美国和欧盟在消费者权益保护方面的相关经验得出启发,最后在立足我国国情的基础上提出完善第三方支付中消费者权益保护的具体措施。论文的主要框架如下:引言部分通过四个案例引出本文讨论的问题,并介绍了论文选题背景及研究意义、国内外研究现状和研究方法。第二部分对第三方支付和消费者权益保护的必要性做了基本介绍。首先明确了本文对第三方支付的定义和研究对象,然后分析了第三方支付机构与消费者之间的法律关系,最后指出了第三方支付中消费者权益面临的风险和对其进行保护的必要性。第三部分系统分析了我国第三方支付中消费者权益保护存在的四大问题,分别是:消费者个人信息安全问题、消费者资金安全问题、第三方支付机构信息披露问题和第三方支付纠纷解决问题。第四部分针对我国第三方支付中消费者权益保护存在的问题,考察了美国和欧盟在这些方面的立法状况,并总结其成功的立法经验以及获得的重要启示。第五部分针对第三部分的四大问题提出了具体的完善建议。在消费者个人信息保护方面,应制定统一的个人信息保护法来明确消费者的个人信息权利、第三方支付机构的信息保障义务和消费者个人信息保护责任机制;在消费者资金安全保护方面,应建立消费者保障险与保障金制度,并明确备付金利息的归属以及完善支付差错处理程序;在支付服务信息披露方面,应丰富信息披露的内容和形式并加强对信息披露的监管;在纠纷解决方面,应明确管辖法院、实行举证责任倒置和建立在线纠纷解决机制。
[Abstract]:With the rapid development of online transactions, third-party payment is favored by consumers because of its convenience and economy. However, its rapid development has also brought a series of problems, among which the protection of consumer rights and interests is the most prominent. Because of the highly fictitious, professional and technical characteristics of third-party payment, the consumers in third-party payment are in a weak position, and their risk prevention ability is weaker than that of ordinary consumers. And our legislation in the field of third-party payment is obviously lagging behind. The provisions on the protection of consumers' rights and interests in third-party payment are very fragmented and flawed, which are very safe for consumers' personal information and funds. The right to know lacks proper protection. The protection of consumers' rights and interests is the central link of the healthy development of the third-party payment industry. Only by implementing the protection of the rights and interests of consumers can the long-term development of the third-party payment industry be guaranteed. By analyzing the basic relationship between third-party payment and consumers, and combining with the case of consumers' rights and interests in practice, this paper probes into the legal problems existing in the protection of the rights and interests of third-party payment consumers in China. Then it draws inspiration from the relevant experiences of the United States and the European Union in the protection of consumer rights and interests, and finally puts forward specific measures to improve the protection of consumer rights and interests in third-party payment on the basis of China's national conditions. The main framework of the paper is as follows: the introduction part leads to the problems discussed in this paper through four cases, and introduces the background and significance of the topic, the current research situation and research methods at home and abroad. The second part introduces the necessity of third-party payment and consumer protection. Firstly, the definition and research object of third-party payment are defined, and then the legal relationship between third-party payment organization and consumers is analyzed. Finally, the paper points out the risks faced by consumers in third-party payment and the necessity of protecting them. The third part systematically analyzes the four problems existing in the protection of consumer's rights and interests in third-party payment in China, which are: consumer personal information security, consumer financial security. Third-party payment agency information disclosure and third-party payment dispute resolution problem. In the fourth part, aiming at the problems existing in the protection of consumer rights and interests in third-party payment in China, the author reviews the legislative situation of the United States and the European Union in these aspects, and summarizes its successful legislative experience and important enlightenment. The fifth part puts forward specific suggestions for the four problems in the third part. In the aspect of consumer personal information protection, it is necessary to establish a unified personal information protection law to clarify consumers' personal information rights, the information protection obligations of third-party payment agencies and the mechanism of consumers' personal information protection responsibility. With regard to the safety protection of consumer funds, we should establish a system of consumer protection insurance and protection benefits, make clear the attribution of interest on reserve payments and improve the procedures for handling payment errors; in terms of disclosure of payment service information, The contents and forms of information disclosure should be enriched and the supervision of information disclosure should be strengthened. In the aspect of dispute resolution, the court should be clearly regulated, the burden of proof should be reversed and the online dispute resolution mechanism should be established.
