商业银行服务收费法律规制研究

【摘要】:随着市场经济的发展,各大商业银行均逐步确立了自己的服务收费权,向金融消费者收取服务费用,一方面是为了弥补成本,另一方面是为了提高服务水平,这是我国商业银行深化金融改革,与国际商业银行接轨的重要举措。由于商业银行服务收费范围日益扩大,《商业银行服务价格管理办法》已经在2014年出台,相比《商业银行服务价格管理暂行办法》,其内容更为丰富,要求更为详细。新的《办法》则将商业银行定价划分为政府指导价、政府定价和市场调节价三类,增加了政府定价,并且在制定主体等方面有了一些改变,使得商业银行服务收费价格更加合理,程序更加公正。虽然《办法》的出台在一定程度上加强了我国法律对商业银行服务收费价格的规制,但是金融业发展速度非常迅速,修改后的《办法》依然不够完善,并且存在不合理之处,还需要进一步修改完善。除了相关法律法规不够完善以外,目前我国对商业银行服务收费的法律规制还存在立法体系混乱,现行法律规定不合理的问题。法律与规章对商业银行定价权主体资格问题的规定互相矛盾,部门规章忽视了人民银行的政府定价主体作用。同时,商业银行的自主定价权过于宽泛,对定价程序的规定也不够合理。除此之外,在对商业银行服务收费本身规定不够健全合理的同时,我国相关法律法规对金融消费者和弱势群体的保护制度也不够完善,缺乏对金融消费者和弱势群体的特殊保护,这些都造成了我国商业银行服务收费的混乱,损害了金融消费者的利益。针对上述问题,我们可以参考借鉴境外发达国家和地区的商业银行收费制度,比如美国、英国和香港等地,吸取他们的相关经验,结合我国的实际情况,完善我国对商业银行服务收费的法律规制。首先,我们要建立一个完善的商业银行服务收费法律体系,将政府指导价制定引入价格听证程序,规范市场调节价,同时健全商业银行服务收费争议解决机制。其次,要通过法律法规加强对消费者和弱势群体在金融服务中合法权益的保护,主要是完善金融消费者权益保护法律体系,构建商业银行服务收费的社会弱势群体法律保护制度。最后要完善现行商业银行服务收费法律规定,严格限制商业银行自主定价范围,完善服务收费定价程序。
[Abstract]:With the development of the market economy, each major commercial bank has gradually established its right to charge fees for its services to financial consumers. On the one hand, it is to make up for the costs, on the other hand, it is to improve the service level. This is our country commercial bank deepens the financial reform, with the international commercial bank the important measure. As the scope of commercial bank service charges is expanding day by day, the "Commercial Bank Service Price Management method" has been issued in 2014, compared with the "Commercial Bank Service Price Management interim measures", its content is more abundant, the request is more detailed. The new "methods" divide the pricing of commercial banks into three categories: government guided prices, government pricing and market adjustment prices, increasing government pricing, and making some changes in the formulation of the main body, etc. Make the commercial bank service charge price more reasonable, the procedure is more just. Although the introduction of "measures" to a certain extent strengthened the regulation of the price of commercial bank services charges, but the financial industry is developing very quickly, the revised "measures" are still not perfect, and there are unreasonable places. Further modifications and improvements are needed. In addition to the relevant laws and regulations are not perfect, the current legal regulation of commercial bank services charges there is confusion in the legislative system, the current legal provisions are unreasonable. The regulations and laws on the qualification of the subject of pricing power of commercial banks contradict each other, and the departmental regulations ignore the role of the government pricing subject of the people's Bank of China. At the same time, the independent pricing power of commercial banks is too broad, and the pricing procedures are not reasonable. In addition, while the regulation of commercial bank service charges itself is not sound and reasonable, the protection system for financial consumers and vulnerable groups by relevant laws and regulations of our country is also not perfect enough. The lack of special protection for financial consumers and vulnerable groups has led to confusion in the charging of commercial bank services in China and has harmed the interests of financial consumers. In view of the above problems, we can draw reference from the commercial bank charging systems of overseas developed countries and regions, such as the United States, the United Kingdom and Hong Kong, draw on their relevant experience and combine the actual situation of our country. Perfect our country to commercial bank service charge legal regulation. First of all, we should establish a perfect legal system of commercial bank service charges, introduce the government guidance pricing into the price hearing procedure, standardize the market price adjustment, and improve the dispute settlement mechanism of commercial bank service charges. Secondly, it is necessary to strengthen the protection of the legitimate rights and interests of consumers and vulnerable groups in financial services through laws and regulations, mainly to improve the legal system for the protection of the rights and interests of financial consumers. Construct the legal protection system of the social vulnerable group of the commercial bank service charge. Finally, it is necessary to perfect the current legal provisions on service charges of commercial banks, strictly limit the range of independent pricing of commercial banks, and perfect the pricing procedures of service charges.
