我国电信业民间资本准入法律制度研究

【摘要】:近年来,全球经济发展低糜,使我国的经济发展受到一定的冲击,暴露出了我国经济市场发展饱和缺乏活力和我国市场经济结构不合理的问题。在我国的电信行业,国有资本控股并垄断电信市场,使得我国电信市场缺乏竞争,发展缓慢。要解决这一问题,国家提出将民间资本引入电信市场,2015年“两会”期间,李克强在2015年“国家政府工作报告”中指出,要在各个行业内大力引入民间资本活跃市场。民间资本在我国经济高速发展的几十年里得到了充分的积累,鼓励民间资本的发展可以解决我国电信市场缺乏活力的问题,合理引导民间资本在电信市场的流向也对我国改革电信市场结构有所助益。要真正的实现民间资本进入电信市场就需要制定一个完善的市场准入法律制度,既能够实现政府鼓励民间资本进入电信业的目的,又能够便于政府对民间资本在电信业的活动进行监管。但目前,我国电信业民间资本准入法律制度不完善,存在市场准入标准过于严格的问题,主要表现为对民间资本的主体资格限制过严,并在民间资本可经营的电信业务范围、民间资本准入的行政许可制度以及民间资本进入电信业的准入路径方面都存在诸多限制。因此,我国目前的电信业民间资本准入法律制度与电信市场发展趋势不配套。要将民间资本引入电信业必须为其提供良好的法律保障和操作标准,因此,在制定电信业市场准入制度时应当充分考虑准入标准的适当性,既要激活民间资本在电信业的活力,又要充分保障电信市场的稳定及信息安全,市场准入标准不宜过分严格,也不宜过于宽松,如此才能更好的指导民间资本在电信业的发展。本文主要分为四个部分:第一部分介绍了我国目前电信业民间资本准入法律制度的现状及不足。本部分从我国民间资本进入电信业的市场准入主体资格、市场准入业务范围、市场准入行政许可制度、市场准入路径几个方面进行分析,得出我国现有电信业民间资本准入标准过于严格,不利于民间资本进入的问题。第二部分对产生这一问题的原因进行了分析,从公有制经济体制理论、集体有限理性、负外部性等理论入手,并在现实层面中就电信业市场准入制度改革的时间成本、政府导向、信息安全保护等问题进行了阐述。第三部分,梳理了美国和日本电信业改革的经验,证明了在电信业引入民间资本的必要性,并借鉴了其改革过程中的优秀成果。最后一个部分结合我国目前电信业民间资本准入法律制度的利弊和国外电信业改革的经验,提出民间资本进入电信业应当遵循的基本原则,并从民间资本进入电信业的市场准入主体资格、市场准入业务范围、市场准入行政许可制度、市场准入路径几个方面的完善提出参考性的建议。
[Abstract]:In recent years, the global economic development has been low, which has made the economic development of our country suffer a certain impact, and exposed the problems of our country's economic market development saturation lack of vitality and the unreasonable structure of our country's market economy. In the telecommunication industry of our country, the state-owned capital holding and monopolizing the telecommunication market make our telecom market lack of competition and develop slowly. To solve this problem, the state has proposed to introduce private capital into the telecommunications market. During the "two sessions" in 2015, Li Keqiang pointed out in the "National Government work report" in 2015 that it is necessary to vigorously introduce private capital into active markets in various industries. Private capital has been fully accumulated in the decades of rapid economic development in China. Encouraging the development of private capital can solve the problem of lack of vitality in our telecommunications market. Reasonably guiding the flow of private capital in the telecommunication market will also help to reform the telecom market structure in China. In order to truly realize the private capital entering the telecommunication market, it is necessary to establish a perfect legal system of market access, which can realize the government's purpose of encouraging private capital to enter the telecommunications industry. It is also convenient for the government to supervise the activities of private capital in the telecommunications industry. However, at present, the legal system of access to private capital in China's telecommunications industry is not perfect, and there is a problem that market access standards are too strict, which mainly shows that the qualification of the subject of private capital is too strict, and the scope of telecommunications business that can be operated by private capital is too strict. There are many restrictions on the administrative license system of private capital access and the entry path of private capital into telecommunications industry. Therefore, China's current private capital access legal system and telecommunications market development trend does not match. In order to introduce private capital into telecom industry, we must provide good legal guarantee and operation standard. Therefore, we should fully consider the appropriateness of admission standard when formulating the market access system of telecommunications industry, and we should activate the vitality of private capital in telecommunications industry. In order to ensure the stability of telecommunication market and information security, the standard of market access should not be too strict or too loose, so as to guide the development of private capital in telecom industry. This paper is mainly divided into four parts: the first part introduces the current situation and deficiencies of the civil capital access legal system in China's telecommunications industry. This part analyzes the qualification of the subject of market access, the scope of market access, the system of administrative permission of market access, and the path of market access. It is concluded that the current private capital admission standards in China are too strict, which is not conducive to the entry of private capital. The second part analyzes the causes of this problem, starting with the theory of public ownership economic system, collective limited rationality, negative externality, and the time cost of the reform of market access system in telecommunications industry. Government guidance, information security protection and other issues are expounded. In the third part, the author combs the experience of telecommunication industry reform in America and Japan, proves the necessity of introducing private capital into telecommunication industry, and draws lessons from the outstanding achievements in the reform process. The last part combines the advantages and disadvantages of China's current private capital access legal system and the experience of foreign telecom industry reform, and puts forward the basic principles that folk capital should follow in entering the telecommunications industry. Some suggestions are put forward from the aspects of the qualification of the subject of market access, the scope of market access, the system of market access administrative license and the path of market access.
