住房公积金制度存废之探讨

【摘要】：住房公积金是解决城市居民住房问题的重要制度,我国的住房公积金制度是从1991年开始,政府推动住房改革从而演变而来的。该制度是以单位和职工个人共同缴纳为核心来运行的,单位方面以职工工资总数按比例缴纳,职工方面直接从其工资中扣除。在我国发展经济的起步阶段,由于政府财政的薄弱,故解决居民住房需求的难题须由居民自身解决,该制度则在当时的社会背景下诞生了。不可否认的是,该制度曾为我国住房建设提供了巨大的助力,若无该制度,社会成员在当时的情况下难以获得住房,故该制度为社会的和谐稳定做出了巨大贡献。然而,随着时代的变迁,国家综合国力的提升与经济的飞速发展,以工资为基数的该制度已不适应当下社会现状,国民收入逐渐呈现两极化分布,致使公积金缴存金额差异也逐步拉大。依上述,该制度在当下社会中,由于有违社会公平、使用率低下、功能性薄弱等问题的存在引起了学界的广泛关注,众多学者均提出了改革措施。但是,目前所提出的改革措施并未有效的解决该制度所存在的问题。基于此,本文将从该制度现存问题谈起,随后对域外住房保障制度的立法经验进行考察并总结,进而采用比较的研究方法指出我国住房公积金制度已经不再适合当下的社会状况,最后将针对各种问题所提出的解决之法进行评析,从而得出该制度应予以废除的结论。
[Abstract]:The housing accumulation fund is an important system to solve the housing problem of urban residents. The housing accumulation fund system of our country began in 1991, and the government promoted the housing reform so as to evolve. This system is with unit and worker individual joint pay as core to run, unit respect is paid by worker salary total amount according to proportion, worker respect is deducted from its salary directly. In the initial stage of economic development in China, because of the weakness of government finance, the problem of solving the housing needs of residents must be solved by the residents themselves, and the system was born under the social background at that time. It is undeniable that the system has provided great help for housing construction in our country. Without this system, it would be difficult for social members to obtain housing at that time, so the system has made great contributions to the social harmony and stability. However, with the change of the times, the promotion of the national comprehensive national strength and the rapid development of the economy, the system based on wages has not adapted to the current social situation, and the national income gradually presents a polarized distribution. As a result, the difference in the amount of provident fund contributions has gradually widened. According to the above, the system in the current society, because of the violation of social justice, low utilization rate, functional weaknesses and other problems caused widespread concern in the academic community, many scholars have proposed reform measures. However, the current proposed reform measures have not effectively solved the existing problems of the system. Based on this, this paper will start from the existing problems of the system, and then review and summarize the legislative experience of the extraterritorial housing security system. Then the comparative research method is used to point out that the housing accumulation fund system is no longer suitable for the social situation in our country. Finally, the methods of solving various problems are evaluated, and the conclusion is drawn that the system should be abolished.
