SDR篮子货币评估法律框架视域下我国外汇管理改革

【摘要】：2016年10月人民币在经历两次SDR篮子货币评估后正式入篮。人民币作为SDR篮子货币中唯一尚未实现可自由兑换的货币,在改革过程中,我国既存在外汇市场化改革中法律规范性文件之间的冲突、法律规制真空、金融衍生品法律规制体系繁杂等问题,也存在外汇管理改革中外汇风险准备金制度不健全、存款准备金制度不完善及跨境资本流动监管体系不完备等问题。因此,我国应注重外汇管理改革与国际规则之间的协调,并健全外汇管理立法体系、完善外汇管理监管体系,以防范外汇管理改革中的金融风险。
[Abstract]:In October 2016, RMB was formally entered into the basket after the two SDR basket currency assessment. The only currency in the SDR basket had not been realized freely. In the process of reform, there was a conflict between the legal normative documents in the reform of the foreign exchange market, the law regulation vacuum, and the legal regulation system of financial derivatives. There are also problems of miscellaneous foreign exchange management reform, imperfect reserve system of foreign exchange risk reserve, imperfect deposit reserve system and incomplete supervision system of cross-border capital flow. Therefore, China should pay attention to the coordination between foreign exchange management reform and international rules, and perfect the foreign exchange management legislation system, and improve the supervision system of foreign exchange management. To guard against financial risks in the reform of foreign exchange management.
