中医药治理体系和治理能力现代化背景下虚假中医药广告行为的法律规制研究

【摘要】:当前中医药事业迎来振兴的重要机遇,全面提升中医药治理体系和治理能力现代化水平成为全面深化改革与全面依法治国的重要组成部分。在这样的社会背景下,中医药治理中的法律问题不得不予以认真对待,其中虚假中医药广告治理是长期突出难题,实现虚假中医药广告行为的法律治理值得专门探究。为此,应当首先明确虚假中医药广告行为的构成要件,对该行为进行类型化分析,并从法治体系的角度寻找虚假中医药广告综合治理的制度。
[Abstract]:At present, the cause of traditional Chinese medicine is facing the important opportunity of rejuvenation. It is an important part of deepening the reform and running the country according to law to improve the management system of Chinese medicine and the modernization level of the ability of governance in an all-round way. In such a social background, the legal problems in the governance of traditional Chinese medicine have to be taken seriously, among which the governance of false Chinese medicine advertisements is a long-term prominent problem, and the legal governance of the practice of false Chinese medicine advertisements is worth exploring. Therefore, we should first make clear the constitutive elements of false Chinese medicine advertisement, analyze the type of the behavior, and look for the system of comprehensive management of false Chinese medicine advertisement from the point of view of the system of rule of law.
