网络购物中反欺诈法律规制研究

【摘要】:伴随着电子科学技术的迅速发展,我们的日常工作生活得到了质的改变,普通大众开始慢慢疏远传统的消费观念和消费模式,网络购物成为了大家青睐的新兴事物。然而网络购物在便利了大家生活的同时也给大家带来了一些烦恼。网络经营者在整个交易的过程中处于优势地位,其中好多经营者利用其优势地位发布一些虚假信息、虚假广告等去欺诈,这样就很容易诱导网上消费者偏离自己的正确判断,实施了使自己利益受损的行为。因此,如何对网络经营者的欺诈行为进行有效规制,使之拥有良好的秩序,有待各位的共同努力研究。本文除前言和结语外,正文主要有以下四个部分构成:第一部分介绍了网络购物欺诈的基本内容。该部分首先给出了网络购物欺诈的概念,即网络经营者在利益的驱动下对自己经营的商品或服务采用虚假描述、虚假宣传等手段诱导消费者购买,从而达到侵害消费者权益的行为。接着对网络购物欺诈的特点进行了归纳总结交易,包括欺诈手段的隐蔽性、范围的扩大带来了欺诈的多样性。还对比研究了网络欺诈与相关概念如网络诈骗的异同,对网络购物欺诈有更直观,更深刻的认识。第二部分详细介绍了我国目前处理网络购物欺诈的现状与不足。我国目前没有专门的规制网络购物欺诈的法律法规,对电子商务的规定零散的出现在民商事法律领域。这就造成了我国不能较好的保障消费者的具体权利,当消费者权益受到侵害时,也没有有效的救济途径。第三部分分析网络购物发达国家在规制网络购物欺诈上的法律规制和先进经验。详细介绍电子商务发达国家或地区的一些立法经验,以美国、日本还有欧盟为例,对他们在网络购物领域的立法进行对比研究。看到了他们在保护网络购物消费者具体权益方面的具体做法,给我们在规制网络购物欺诈方面提供了启示。第四部分提出保障我国网络购物消费者权益的具体建议。根据我们现在网络购物领域面临的问题加上外国先进做法给我们的启示,我们要做到以下几个方面。首先,我们应该完善健全相关的法律、地方法规和相关的部门规章,其次我们需要制定和引进冷却期制度、规制格式合同、构建统一的网络维权平台等保证消费者的合法权益;最后,构建小额诉讼机制和在线纠纷解决机制,完善我国维护消费者权益的机制。
[Abstract]:With the rapid development of electronic science and technology, our daily work life has been qualitatively changed, the ordinary people began to slowly alienate the traditional consumption concept and consumption mode, online shopping has become a popular new thing. However, online shopping not only facilitates everyone's life, but also brings us some troubles. Network operators are in an advantageous position in the course of the whole transaction. Many of them use their dominant position to issue some false information, false advertisements and so on to defraud, thus it is easy to induce online consumers to deviate from their correct judgment. The act of harming one's own interests was carried out. Therefore, how to regulate the fraud of network operators effectively and make it have a good order is to be studied. In addition to the preface and conclusion, the text consists of the following four parts: the first part introduces the basic content of online shopping fraud. This part first gives the concept of online shopping fraud, that is, network operators in the interests of their own goods or services to use false description, false advertising and other means to induce consumers to buy. Thus, the behavior of infringing on consumers' rights and interests is achieved. Then, the characteristics of online shopping fraud are summarized, including the concealment of fraud means, the expansion of the scope of fraud brings the diversity of fraud. In addition, the similarities and differences between online fraud and related concepts such as network fraud are compared, and a more intuitive and profound understanding of online shopping fraud is obtained. The second part introduces the current situation and deficiency of dealing with online shopping fraud in China. At present, there are no special laws and regulations to regulate online shopping fraud, and the provisions of electronic commerce appear scattered in the field of civil and commercial law. This causes that our country can not better protect the specific rights of consumers, when the rights and interests of consumers are infringed, there is no effective remedy. The third part analyzes the legal regulation and advanced experience of online shopping fraud in developed countries. This paper introduces some legislative experiences of electronic commerce developed countries or regions in detail. Taking the United States, Japan and the European Union as examples, this paper makes a comparative study on their legislation in the field of online shopping. See their specific practices in protecting the specific rights and interests of online shopping consumers, and provide us with enlightenment in regulating online shopping fraud. The fourth part puts forward specific suggestions to protect the rights and interests of online shopping consumers in China. According to the problems we are facing in the field of online shopping and the enlightenment from foreign advanced practices, we should do the following. First, we should perfect and perfect the relevant laws, local regulations and relevant departmental regulations. Secondly, we need to formulate and introduce the cooling period system, regulate the format contract, and build a unified network platform to protect the legitimate rights and interests of consumers. Finally, build up the mechanism of small lawsuit and online dispute resolution, perfect the mechanism of protecting consumer's rights and interests in our country.
