网约车市场准入问题研究

【摘要】:在移动互联网技术与传统行业融合发展的背景下,我国产生了一种以信息平台化和共享经济为特征的交通新业态——网约车。网约车服务,不仅迎合了市民的出行需求,而且开辟了新的服务领域。但是,网约车的出现给传统出租车市场带来了较大影响,伴随网约车发展的是社会各界争议。因此,网约车市场准入问题也成为现行道路运输市场亟待解决的重要问题。目前,在笔者所见的诸多研究资料中,有较多文献讨论了法制视角下网约车的合法性问题,但少有涉及网约车的市场准入问题。本文以此为切入点,围绕网约车该不该市场准入展开讨论。由于网约车市场准入问题的理论性、政策性和实践性都很强,本文在对我国运输市场准入理论研究的基础上,通过参考国内外部分城市汽车预约服务经营模式的相关文献,结合交通运输部的会议文件精神,从理论层面对网约车市场准入问题做出以下几个方面的研究。首先,本文从网约车服务的概念展开讨论,对网约车的特征、类型、产生原因以及面临的现实困境作简要介绍。其次,在梳理运输市场准入相关概念的基础上,阐述了我国当前网约车市场准入现状及主要影响因素,说明现行网约车行业还未建立起一套完整的市场准入制度。最后,通过采用资料分析、对比分析等研究方法对国外有关实践经验分析得出网约车市场准入管制的启示,进而对我国网约车市场准入主体、准入基本条件、准入程序、准入方式等几方面进行了详细论述,并提出了自己的一些建议。
[Abstract]:Under the background of the convergence of mobile Internet technology and traditional industry, a new traffic mode, named car-sharing, which is characterized by information platform and sharing economy, has emerged in China. Ride-hailing service not only caters to the public's travel demand, but also opens up a new service field. However, the emergence of net-ride-hailing has brought great influence to the traditional taxi market, with the development of net-ride-sharing, which is controversial from all walks of life. Therefore, the issue of market access for ride-sharing has become an important issue to be solved in the current road transport market. At present, among the many research materials the author has seen, there are many documents discussing the legality of the net ride-sharing under the legal perspective, but few of them are concerned with the market access of the net-ride-hailing. This article as a starting point, around the net car market access should not be discussed. Due to the strong theoretical, policy and practical nature of the market access problem, this paper, on the basis of the theoretical study of China's transport market access, refers to the relevant documents of some cities at home and abroad on the operation mode of automobile reservation service. Combined with the spirit of the conference documents of the Ministry of Transport, this paper makes the following research on the issue of market access in terms of theory. Firstly, this paper discusses the concept of ride-hailing service, and briefly introduces the characteristics, types, causes and practical difficulties of net-ride-hailing service. Secondly, on the basis of combing the related concepts of transport market access, this paper expounds the current market access situation and main influencing factors in China, and explains that the current market access system has not been established. Finally, by means of data analysis, comparative analysis and other research methods, the author draws the enlightenment of the regulation of ride-sharing market access in foreign countries, and then gives the main body, basic conditions and procedures of market access to China's net-ride-hailing market. Access methods and other aspects of the detailed discussion, and put forward some suggestions.
