GPA契机下我国政府采购法律制度的完善

【摘要】：政府采购伴随国家的产生而产生,随世界贸易的拓展而发展。世界贸易组织(简称WTO)于1994年发布《政府采购协定》(Government Procurement Agreement,以下简称GPA),倡导各国政府间采购的国民待遇原则或非歧视原则。如何建立完善政府采购制度以有效规范政府采购行为,是各国政府以及国际组织共同面对之议题。WTO框架下,中国政府目前还没有签署政府采购协议(GPA),但随着近期中澳自由贸易协定(FTA)的签订,实质上是中澳两国议定有关GPA的条款,标志着中国自贸区高标准升级。在GPA框架下完善我国政府采购法律制度,日益受学界及实务界的广泛关注。
[Abstract]:Government procurement comes into being with the emergence of the country and develops with the expansion of world trade. The World Trade Organization (WTO) issued the Agreement on Government Procurement (Government Procurement Agreement,) in 1994, which is referred to as GPA), which advocates the principle of national treatment or non-discrimination in government procurement. How to establish and perfect the government procurement system in order to effectively standardize the government procurement behavior is a common topic that governments and international organizations face under the framework of WTO. The Chinese government has not yet signed a government procurement agreement, (GPA), but with the recent signing of the China-Australia Free Trade Agreement (FTA), the two countries have essentially agreed terms on the GPA, marking an escalation of high standards in China's free trade zone. Improving the legal system of government procurement under the framework of GPA has been paid more and more attention by scholars and practitioners.
