建设项目工程变更的法律效力分析研究

【摘要】：由于合同条件是有限的、固定的,而外界世界是无限的、变化的。因此对于建设项目,工程变更是不可避免的,它影响着建设项目的进度、质量、成本三大方面。业主作为建设工程中重要的参与主体,拥有工程变更的绝对权利,特别是对于政府投资建设项目更是如此。为了明确业主工程变更的权限以及规范业主工程变更的行为,非常有必要对工程变更的法律效力进行研究。本文是从法律效力角度对工程变更进行了研究与分析,结合法律、行政法规、部门规章的有关条款对工程变更的法律效力进行界定。首先,本文在分析国内文献和有关学者的观点基础上,介绍了建设项目、工程变更的基本概念,并归纳了与工程变更有关的法律条款。其次,对建设项目工程变更的特殊性进行分析研究。找出了工程变更的七大生成因素和四个不合法因素,并深入研究了工程变更的不合法衍生机理,归纳出工程变更不合法的问题。然后,根据工程实例,结合有关法律条款,分别在工程建设标准、工程造价、工期等三个方面界定工程变更的法律效力。最后,在现有法律体系中,找到无法界定法律效力的工程变更,并对其进行分析研究,提出合理的解决建议。
[Abstract]:Because the contract conditions are limited, fixed, and the outside world is infinite, changing. Therefore, for the construction project, engineering change is inevitable, which affects the progress, quality and cost of the construction project. The owner, as an important participant in the construction project, has the absolute right to change the project, especially for the construction project invested by the government. In order to clarify the authority of owner's engineering change and standardize the behavior of owner's engineering change, it is necessary to study the legal effect of engineering change. This paper studies and analyzes the engineering change from the point of view of legal effect, and defines the legal effect of engineering change by combining the relevant provisions of laws, administrative regulations and departmental regulations. Firstly, based on the analysis of the domestic literature and the views of the scholars concerned, this paper introduces the basic concepts of the construction project and the engineering change, and summarizes the legal provisions related to the engineering change. Secondly, the particularity of construction project change is analyzed and studied. This paper finds out the seven factors of generating engineering change and four illegal factors, and deeply studies the mechanism of illegitimate derivation of engineering change, and sums up the problem of illegality of engineering change. Then, according to the engineering examples, combined with the relevant legal provisions, the legal effect of engineering change is defined in three aspects: construction standard, project cost and time limit. Finally, in the existing legal system, we find out the engineering change which can not define the legal effect, and make an analysis and study on it, and put forward some reasonable solutions.
