论非金融机构网络支付平台客户权益法律保护
[Abstract]:Non-financial institution network payment platform is a new payment medium rising with the continuous development of online purchase. With the rapid development of electronic commerce, the application of this payment method is more and more extensive. At the same time, there are more and more legal problems to be solved in practice. China's current legislation on non-financial institutions network payment platform provisions are not perfect, in the protection of non-financial institutions network payment platform customer rights and interests also has a lot of shortcomings. In order to promote the healthy development of the network payment platform of non-financial institutions and better protect the legitimate rights and interests of customers, it is urgent to establish a legal system in line with the current situation of the development of the network payment industry of non-financial institutions in China. In contrast, foreign non-financial institutions network payment industry developed earlier, academic research and legal provisions are relatively rich and perfect. For example, the United States law provides for the implementation of deposit extension insurance system for network payment of non-financial institutions, which solves the problem of the ownership of the fruits of customer reserve and greatly reduces the possibility of embezzlement and illegal utilization of customer reserve. By comparing the practice of legal protection of customer rights and interests between China and the United States and Europe, this paper sums up the shortcomings of our current law, and on the basis of absorbing the advanced experience of foreign countries, To improve the legal protection of customer rights and interests of network payment platform of non-financial institutions in China. This paper is divided into four parts: the first part analyzes the connotation of the network payment platform of non-financial institutions, the definition of customers, the three pairs of legal relations involved in the payment process. Then it expounds the six types of customer rights and interests in the network payment platform of non-financial institutions (that is, customer's right to fair trade, option, property security, right to know, right to claim damages, right to keep information secret). The second part introduces the relevant legal systems of foreign countries, mainly analyzes the relevant experiences of the two countries and regions, such as the United States and the European Union, where the legislative experience is relatively mature, and summarizes their merits. In order to compare with the legal practice of protecting the rights and interests of the network payment platform of non-financial institutions in our country, we can learn from each other. The third part, on the basis of expounding the current situation of the implementation of the laws and regulations of the network payment platform of the non-financial institutions in China, points out the main problems existing in the protection of the rights and interests of the customers of the network payment platform of the non-financial institutions in our country. In the fourth part, aiming at the shortcomings of the legal norms of protecting the rights and interests of the network payment platform of non-financial institutions in China, the author proposes that the obligation of the network payment platform of the non-financial institution should be clarified and the supervision of the network payment platform of the non-financial institution should be strengthened. The countermeasures and suggestions of perfecting the procedure relief after the customers of the network payment platform of the non-financial institution are damaged and standardizing the market access and exit mechanism of the network payment platform of the non-financial institution, In order to improve the legal system of customer rights and interests protection of network payment platform of non-financial institutions.
