金融生态视角下农村金融运行的问题及法律对策研究

【摘要】：金融是国家社会主义建设的重要内容,也是进行社会建设的经济基础与支撑,农村金融作为金融一个分支,也发挥着对社会建设的重要作用,然而更为特殊的是,农村金融有着服务“三农”的目标和功能,也因其与“三农”有着天然的联系,面临着许多困境,具有脆弱性。在全面深化改革的市场经济时代,金融也在不断改革,中央各项支农文件和政策也在不断向农村经济的发展倾斜,农村金融有利好趋向,农村金融打破困境,实现循环可持续发展既是农村经济发展的必然要求,也是农村金融发展的面临的必然选择和方向。农村金融在市场运行中,发挥主要作用的是农村政策性金融机构和农村商业性金融机构,因其不同的特点和功能,二者在运行中存在着不同的问题,因此,要从问题出发,寻找有针对性的不同解决机制。本文旨在以生态金融为视角,将生态金融的理念和特点赋予农村金融运行中,为最终实现农村金融的生态化、可持续、循环运作探寻法律对策。农村金融生态包含法制、农村信用体系、贷款人等诸多方面的平衡、协调,是诸多因素的有机统一,但本文仅围绕法律因素,解决农村金融运行中的不和谐,不可循环问题。本文通过收集农村政策性金融机构和农村商业性金融机构存、贷款数额,资金来源,各项贷款去向和数额等资料,在分析此运行现状的基础上找到农村政策性金融存在资金来源不合理以及资金供给不合理的问题;然后分析了村镇银行有存、贷款业务不协调和资金流失严重的问题;再者,根据这些不同的问题,提出了相应的完善农村政策性金融机构的法律对策和农村商业性金融机构的倾斜性法律对策,以期能最终有助于农村金融的可持续发展,真正发挥农村金融的“支农助农”的作用和使命。
[Abstract]:Finance is the important content of national socialist construction, and also the economic base and support of social construction. As a branch of finance, rural finance also plays an important role in social construction. Rural finance has the goal and function of serving agriculture, rural areas and farmers, and also faces many difficulties and vulnerabilities because of its natural relationship with agriculture, rural areas and farmers. In the era of market economy with comprehensive deepening of reform, the financial sector is also constantly reforming, and various supporting agricultural documents and policies of the central authorities are also constantly tilting towards the development of the rural economy. Rural finance has a positive trend, and rural finance has broken the predicament. The realization of circular sustainable development is not only the inevitable requirement of rural economic development, but also the inevitable choice and direction of rural financial development. In the market operation of rural finance, the main function is rural policy-oriented financial institutions and rural commercial financial institutions. Because of their different characteristics and functions, there are different problems in the operation of rural finance. Look for different solutions. The purpose of this paper is to endow the concept and characteristics of ecological finance with the operation of rural finance from the perspective of ecological finance, and to explore legal countermeasures for the ultimate realization of ecological, sustainable and circular operation of rural finance. Rural financial ecology includes the balance and coordination of legal system, rural credit system, lender and so on, which is the organic unity of many factors, but this paper only revolves around the legal factors to solve the problems of disharmony and non-circulation in the operation of rural finance. This paper collects the data of rural policy-oriented financial institutions and rural commercial financial institutions, such as deposit, loan amount, source of funds, destination and amount of various loans, etc. On the basis of analyzing the current situation of operation, we find out that the rural policy-oriented finance has some problems, such as the unreasonable source of funds and the unreasonable supply of funds; then, it analyzes the problems of the existence of savings in rural banks, the disharmony of loan business and the serious loss of funds. According to these different problems, this paper puts forward the corresponding legal countermeasures to perfect the rural policy-oriented financial institutions and the preferential legal countermeasures of the rural commercial financial institutions, in the hope that it can ultimately contribute to the sustainable development of rural finance. Give full play to the role and mission of rural finance "supporting agriculture and helping agriculture".
