移动通信转售业务的反垄断法分析

【摘要】:文章在简要介绍我国移动通信转售业务的基础上,对移动通信转售过程中接入和零售这两个基本环节中转售企业与基础运营商之间的关系进行了分析,随后,文章结合电信产业的网络型特征着重对移动通信网络接入环节中市场主体的地位特别是基础运营商的市场支配地位进行了分析,并在此基础上对接入市场可能出现的滥用市场支配地位以及垄断协议行为进行了预判和梳理。文章由六个部分组成:导论呈现文章的选题背景并介绍了学界对移动通信领域引入竞争的相关研究成果。简单交待了创新点及诸多不足之处。此外,本部分还廓清了研究范围,指出本文主要研究移动通信转售业务可能引发的经济性垄断且不包括其中的经营者集中行为。第一章在简要介绍移动通信转售业务的基础上,从反垄断法的角度对转售业务的竞争效果、相关市场、经营者之间的关系等进行了分析。指出转售业务既有促进竞争的积极效果,同时,围绕转售业务,也可能发生一些限制竞争的行为,运营商开展竞争的相关市场为移动通信服务市场,运营商之间存在既合作又竞争的关系,在批发环节,基础运营商与转售企业之间是合作关系,而在零售环节,所有运营商之间互为竞争者。在以上分析的基础上,本章提出了转售业务可能引发的反垄断法担忧。第二章着重分析转售业务相关的滥用市场支配地位,主要结合网络性的产业特征对滥用市场支配地位的行为类型、表现形式展开分析,指出基础运营商可能滥用其优势拒绝转售企业接入、收取不公平的高价或为在零售竞争中占得先机而恶意降低接入质量。第三章主要分析了围绕转售业务可能发生的垄断协议,特别是接入环节的纵向垄断协议和横向垄断协议,指出基础运营商之间可能就接入价格等接入条件进行共谋,而各基础运营商在与转售企业合作的过程中,可能与转售企业达成纵向限制协议。第四章结合电信产业作为管制型产业的特性,探讨了通信产业监管机制与反垄断执法机制协调的问题,以及针对移动通信服务领域进行反垄断执法的过程中产业监管机构与反垄断执法机构合作的问题。结论部分强调了在我国移动通信领域放松进入管制、引入竞争的重要性,以及在开放竞争的同时加强竞争执法关注的必要性。
[Abstract]:On the basis of a brief introduction to the resale service of mobile communications in China, this paper analyzes the relationship between the resale enterprises and the basic operators in the two basic links of access and retail in the process of the resale of mobile communications, and then analyzes the relationship between the resale enterprises and the basic operators. Combined with the network characteristics of telecommunication industry, this paper analyzes the position of the market main body in the access link of mobile communication network, especially the dominant position of the basic operator. On this basis, the possible abuse of market dominance and monopoly agreement behavior in access market are forecasted and combed. The article is composed of six parts: introduction presents the background of the selected topic and introduces the related research results of the academic field on the introduction of competition in the field of mobile communications. A simple explanation of innovation and many shortcomings. In addition, this part clarifies the scope of the research, and points out that this paper mainly studies the economic monopoly which may be caused by the resale of mobile communication and does not include the centralized behavior of the operators. In the first chapter, based on the brief introduction of the resale business of mobile communication, the author analyzes the competitive effect of resale business, the related market and the relationship between the operators from the angle of anti-monopoly law. It is pointed out that resale business has the positive effect of promoting competition, at the same time, some behaviors of restricting competition may occur around resale business. The related market for operators to carry out competition is the market of mobile communication service. There is a relationship of cooperation and competition between operators. In the wholesale link, between the basic operator and resale enterprise is the cooperative relationship, but in the retail link, all operators are competitors each other. On the basis of the above analysis, this chapter raises the concerns of anti-monopoly law which may arise from resale business. The second chapter focuses on the analysis of the abuse of market dominance related to resale business, mainly combined with the characteristics of the network industry to analyze the behavior types and forms of abuse of market dominance. It is pointed out that basic operators may abuse their advantages to refuse resale enterprise access, charge unfair high prices or maliciously reduce the quality of access in order to gain an advantage in retail competition. The third chapter mainly analyzes the possible monopoly agreements around resale business, especially the vertical monopoly agreement and horizontal monopoly agreement, and points out that access conditions such as access price may be colluded among the basic operators. In the process of cooperation with resale enterprises, each basic operator may reach vertical restriction agreement with resale enterprises. The fourth chapter discusses the coordination between the regulatory mechanism and the anti-monopoly law enforcement mechanism of the telecommunications industry in combination with the characteristics of the telecommunications industry as a regulatory industry. And the cooperation between industry supervision and anti-monopoly law enforcement in the process of anti-monopoly law enforcement in the field of mobile communication service. The conclusion emphasizes the importance of loosening entry control and introducing competition in the field of mobile communication in China, as well as the necessity of strengthening competition law enforcement while opening up competition.
