跨境网购海关监管法律问题研究

【摘要】：随着我国经济发展水平的不断提高以及网络信息技术的发展,越来越多的人开始关注生活品质的改善,对商品品种、质量、规格、多样性等要求的标准越来越高,跨境网购在此背景下应运而生。跨境网购对于海关监管来说仍然是一个比较新的领域,从笔者搜集到的资料来看,现有的研究成果更多的将关注的焦点集中在网购行为产生的弊端,强调海关要加强对非法跨境网购的打击,弥补监管漏洞等,缺少针对跨境网购海关监督立法领域的研究成果。笔者认为,跨境网购是一种快速发展的新型经济形态,一味的对其进行管制和限制是不正确的,应该正视此种经济形态的发展前景,通过法律的完善、制度的创新、政策的改进,在实现海关对跨境网购进行有效监管的同时,促进跨境网购的健康发展。因此,本文的研究具有一定的理论和实践意义。本文采用的研究方法有文献研究法、案例分析法、比较分析法。本文共分为五个部分。第一部分为绪论,对本文选题的背景、意义、研究方法与框架、文献回顾进行了分析。第二部分为我国跨境网购业务的发展情况概述,包括我国跨境网购业务的发展现状,我国跨境网购业务发展的趋势,我国跨境网购业务的海关监管现状。第三部分为我国跨境网购的政府监管法律现状及存在问题,包括海关监管法律现状及海关监管中存在的问题两部分内容,并结合具体案例进行了分析。第四部分为跨境网购海关监管法律问题改善路径探究,包括完善电商法律政策体系、健全海关监管法律体系、开发跨境电子贸易管理技术平台等内容。第五部分为结语,在全文分析的基础上,进行总结性陈述。经过全文的研究分析,本文指出了当前跨境网购海关监管中存在的法律法规滞后,执法依据不足；偷逃税款的行为难以发现；监管政策常受质疑,舆情应对能力不足；配套措施缺乏,监管力量薄弱等问题,提出了完善电商法律政策体系、健全海关监管法律体系、开发跨境电子贸易管理技术平台等跨境网购海关监管法律问题的改善路径。
[Abstract]:With the continuous improvement of our country's economic development level and the development of network information technology, more and more people begin to pay attention to the improvement of the quality of life, and the standards for the variety, quality, specification and diversity of commodities are becoming higher and higher. Cross-border online shopping in this context came into being. Cross-border online shopping is still a relatively new area for customs supervision. From the information collected by the author, the existing research results focus more on the drawbacks of online shopping behavior. It is emphasized that the customs should strengthen the crackdown on illegal cross-border online shopping, make up for the loopholes in supervision, and lack the research results in the legislative field of customs supervision of cross-border online shopping. The author believes that cross-border online shopping is a new economic form of rapid development, it is incorrect to blindly regulate and restrict it, we should face up to the development prospects of this economic form, through the perfection of the law, the innovation of the system. The improvement of the policy can promote the healthy development of cross-border online shopping while realizing the effective supervision of cross-border online shopping by customs. Therefore, the study of this paper has some theoretical and practical significance. The research methods used in this paper are literature research, case analysis and comparative analysis. This paper is divided into five parts. The first part is the introduction, the background, significance, research methods and framework, literature review. The second part is an overview of the development of cross-border online shopping business in China, including the status quo of cross-border online shopping business in China, the development trend of cross-border online shopping business in China, and the current situation of customs supervision of cross-border online shopping business in China. The third part is the current situation and existing problems of government supervision of cross-border online shopping in China, including the current situation of customs supervision law and the existing problems in customs supervision. The fourth part explores the ways to improve the legal issues of cross-border online shopping customs supervision, including perfecting the legal policy system of e-commerce, perfecting the legal system of customs supervision, developing the technical platform of cross-border electronic trade management, and so on. The fifth part is the conclusion, on the basis of the full text analysis, carries on the summary statement. Through the research and analysis of the full text, this paper points out the existing laws and regulations in the customs supervision of cross-border online shopping are lagging behind, the law enforcement basis is insufficient, the behavior of evading tax is difficult to find, the supervision policy is often questioned, the public opinion response ability is insufficient; Some problems such as lack of supporting measures and weak supervision power are put forward to improve the legal system of electronic commerce, perfect the legal system of customs supervision, and develop the technical platform of cross-border electronic trade management to improve the legal issues of cross-border online shopping customs supervision.
