论我国保险公司破产前置程序的实践、困境及解决之道

【摘要】：保险公司破产前置程序主要表现为通过有力的行政干预对问题保险公司进行风险处置,避免破产司法程序的启动,以降低保险公司破产事件对整个金融秩序和经济社会的高度负外部性。我国现有立法原则规定了保险公司破产前置程序的相关问题,实践中也发生了一些启动前置程序进行风险处置的案例,但显然还存在行政权力一支独大、保险保障基金使用不规范、前置程序难以向司法程序顺利过渡等诸多问题。借鉴美国、日本保险业以及我国其他金融行业的有益经验,我国应通过增加程序性要求、合理限制保险保障基金的用途以及细化前置程序与司法程序的衔接要求等方式不断完善提高保险公司破产前置程序的立法和执法实践。
[Abstract]:The pre-bankruptcy procedure of the insurance company mainly shows that it can deal with the risk of the problem insurance company through the powerful administrative intervention to avoid the commencement of the bankruptcy judicial proceedings. In order to reduce the bankruptcy of insurance companies to the overall financial order and economic and social highly negative externalities. The existing legislative principles of our country stipulate the related problems of the pre-bankruptcy procedure for insurance companies. In practice, there have also been some cases of initiating the pre-procedure for risk disposal, but obviously there is still a monopoly of administrative power. The use of insurance guarantee fund is not standardized, and it is difficult to make a smooth transition to judicial procedure. Drawing lessons from the useful experience of the United States, Japan's insurance industry and other financial industries in China, China should increase its procedural requirements by adding procedural requirements. In order to improve the legislation and enforcement practice of insurance company's bankruptcy pre-procedure, it is necessary to restrict the use of insurance guarantee fund reasonably and to refine the connection requirements between pre-procedure and judicial procedure.
