论违法建筑物的法益保护

【摘要】：在《城乡规划法》《土地管理法》等相关法律相继出台之后,对于违法建筑物如何处理的问题显得尤其重要。近几年来,由于违法建筑物的数量急剧上升,行政主管部门对此也加大排查力度,严格处理违法建筑物的问题。文章从法益的角度来分析违法建筑物,进而得出对违法建筑物较为合理、合法的处理方式。
[Abstract]:After the introduction of the Urban and Rural Planning Law, the Land Management Law and other relevant laws, it is particularly important for how to deal with illegal buildings. In recent years, due to the sharp increase in the number of illegal buildings, the administrative authorities have also stepped up their efforts to investigate and strictly deal with the problem of illegal buildings. This paper analyzes illegal buildings from the point of view of legal interests, and then obtains a more reasonable and legal way to deal with illegal buildings.
