从衔接的角度看中译英立法文本翻译对等 ——From the Perspective of Cohesion

在法律翻译中,语篇衔接理论很少被应用于对法律文本对等的检测。并且,由于立法语篇作为特殊的文体,具有自己的特点,像分析普通翻译文本一样用衔接理论去分析立法文本是不够的,因而本文结合立法文本的特点运用了两个标准来确保衔接理论测试立法语篇翻译的质量。 基于以上理论,本文使用衔接理论结合两条标准对中英立法文本的翻译对等进行测试。本文利用描述和对比分析的方法对中国一些立法文本的英文翻译对等进行测试。通过本文提出的理论框架对大量立法文本的翻译对等进行详细的分析统计,发现在使用衔接手段的各种情况下,存在着不同程度的不对等,包括主观错误,违反译名同一律,滥用指称,忽视逻辑连接词,错误理解代替和省略等。结果表明使用衔接手段结合两个标准测试翻译对等是一个有效的手段。法律文本的翻译质量还有待进一步提高。 有鉴于此,本文进一步提出可以借此理论来研究其他法律文本如司法文本的翻译质量。
