【摘要】: 依据我国航运法律体系,水路货物运输分为国际海上货物运输和沿海、内 河货物运输。前者主要受1993年开始实施的《海商法》的调整,规范我国港 口与外国港口之间的国际海上货物运输,简称国际水路货物运输;后者受《民 法通则》、《合同法》及交通部制定的《国内水路货物运输规则》等部门规章的 调整,,规范我国港口之间的水路货物运输,简称国内水路货物运输。本论文主 要对水路货物运输合同中人们关注的几个问题进行了探讨。 第一章是绪论部分。在介绍了《合同法》的立法背景后,分析了《合同法》 与《海商法》的关系以及其对我国国内水路货物运输合同的影响,同时对新《两 规》的主要特点做了介绍。 第二章是关于船期表的法律性质。该章主要就船期表是要约的观点提出质 疑,指出其法律性质应为要约邀请,并就此做了论述。 第三章是关于归责原则。该章从归责原则的概念入手,分析了《合同法》 确立的严格责任制,以及严格责任制对我国水路货物运输法的影响。 第四章是关于海上货物留置权。笔者在对留置权的概念及一般法律特征进 行阐述后,论述了海上货物留置权的几个主要问题,如对《海商法》第87条 规定的“其货物”的理解,行使海上货物留置权应注意的问题等。 第五章是关于无人提货的问题。该章在分析了无人提货的概念及性质后, 阐述了承运人对无人提取货物的权利:凭单交付责任的免除权、对无人提取货 物的留置权、处置权和对托运人的请求权;同时也阐述了承运人对无人提取货 物的义务:对货方的通知义务和对无人提取货物的合理处置义务。 第六章是关于国内水路货物运输的索赔期限。该章主要就1995年《水路 货物运输规则》第90条规定的“180天索赔期限”的立法初衷和法律性质进 行了分析,指出该期限并非除斥期间,应为诉讼时效;并就其与《海商法》规 定的“一年”诉讼时效的冲突做了分析。 围绕着水路货物运输合同的上述几个问题,笔者对目前存在的观点进行了 评析,并提出了自己的见解,希望为我国水路货物运输法制的完善尽一份绵薄 之力。
[Abstract]:According to our country's shipping law system, waterway cargo transport is divided into international maritime cargo transport and coastal transport. River cargo transport. To regulate the waterway freight transport between ports in China. This paper discusses several problems that people pay attention to in waterway freight transport contract. The first chapter is the introduction part. After introducing the legislative background of the contract Law, the author analyzes the contract Law. The relationship between Maritime Law and Maritime Law and its influence on China's domestic contract of Carriage of goods by Waterway. The main features of the rules are introduced. The second chapter deals with the legal nature of the schedule of ships. This chapter is mainly concerned with the view that the schedule is an offer. This paper points out that its legal nature should be an invitation to offer. The third chapter is about the principle of imputation. This chapter starts with the concept of imputation principle and analyzes the contract Law. Established strict responsibility system, and strict responsibility system of China's waterway freight transport law. Chapter 4th is about the lien of goods on the sea. The author introduces the concept and general legal characteristics of lien. After expounding, several main problems of lien on goods at sea, such as article 87 of the Maritime Law, are discussed. The definition of "its goods" and the problems to be paid attention to in the exercise of lien of goods at sea. Chapter 5th deals with the problem of unsolicited goods. After analyzing the concept and nature of unsolicited goods, This paper expounds the carrier's right to the unfettered goods: the right of exemption from the liability for delivery of vouchers, and the right of delivery of the goods to no one. Lien, disposition, and claim against the shipper; at the same time, the carrier's claim to the unsolicited goods. Obligations in rem: obligations of notification to parties and reasonable disposal of unfettered goods. Chapter 6th is about the period of claim for domestic waterway freight transportation. Legislative intent and legal nature of the "180-day claim period" set out in article 90 of the rules governing the carriage of goods. It is pointed out that the time limit is not a period of exclusion, but a limitation period of action; and in connection with the provisions of the Maritime Code, it is also pointed out that this period is not a period of exclusion. The conflict of the fixed "one year" statute of limitations is analyzed. On the basis of the above problems in the contract of carriage of goods by waterway, the author has carried on the opinion that exists at present. This paper analyzes and puts forward his own opinion, hoping to do a little for the perfection of the legal system of waterway freight transportation in our country. Power.
