【摘要】：海洋油气的勘探与开发是世界油气勘探与开发的重要领域,其资源储备量巨大,勘探前景良好,而海洋油气开发不可或缺的装置便是移动式钻井平台。现代海上钻井平台体积庞大,技术复杂,造价昂贵,一旦遭遇事故,损失将会是十分巨大的。同时,海上钻井市场因受市场资源、自然环境、政治等因素的影响较大,具有较强的不确定性,投资风险较大,这就需要引入一些风险分摊措施。特别是2010年4月20日墨西哥湾石油泄漏事件发生后,引起了人们对移动式钻井平台保险的广泛关注。因此,移动式钻井平台保险就显得尤为重要。文章共分五个部分。第一部分是对移动式钻井平台保险的概述,介绍了利用移动式钻井平台开发石油的前景,移动式钻井平台保险的特点以及对移动式钻井平台进行保险的必要性。第二部分分析了移动式钻井平台的法律地位,澄清了移动式钻井平台保险的法律性质,并且明确了其应当适用的法律规范。第三部分和第四部分,通过对海商法及保险法基本原理的运用,结合我国人民财产保险股份有限公司“钻井船一切险”条款,对移动式钻井平台保险的格式条款进行了分析,主要论述了在移动式钻井平台保险中被保险人的主要义务,保险人的主要义务以及一些特殊赔偿的支付。文章最后一部分在总结保险实务中存在的问题的基础上,提出对我国人民财产保险股份有限公司“钻井船一切险”条款的完善建议。
[Abstract]:The exploration and development of offshore oil and gas is an important field of oil and gas exploration and development in the world. And the indispensable device for offshore oil and gas development is the mobile drilling platform. The modern offshore drilling platform is huge in size, complex in technology and expensive in cost. Once it encounters an accident, the losses will be enormous. At the same time, The offshore drilling market is greatly influenced by market resources, natural environment, politics and other factors, and has strong uncertainty and investment risks. This requires the introduction of some risk-sharing measures. In particular, following the oil spill in the Gulf of Mexico on April 20, 2010, there has been widespread concern about the insurance of mobile drilling rigs. Mobile drilling platform insurance is particularly important. This paper is divided into five parts. The first part is an overview of mobile drilling platform insurance, and introduces the prospects of oil development by mobile drilling platform. The characteristics of mobile drilling platform insurance and the necessity of mobile drilling platform insurance. The second part analyzes the legal status of mobile drilling platform and clarifies the legal nature of mobile drilling platform insurance. The third and fourth parts, through the application of the basic principles of maritime law and insurance law, combined with the "drilling ship all risks" clause of the people's property Insurance Co., Ltd. This paper analyzes the standard terms of mobile drilling platform insurance, and mainly discusses the main obligations of the insured in the mobile drilling platform insurance. The main obligations of the insurer and the payment of some special compensation. The last part of the article summarizes the problems existing in the practice of insurance. This paper puts forward some suggestions for perfecting the clause of "all risks for drilling vessels" of the people's property Insurance Co., Ltd.
