论知识产权领域内智力成果的标准化

【摘要】：在传统观念中,具有私权属性的知识产权与作为公共事务管理工具的技术标准是相互排斥的。但随着信息革命的到来,技术标准与知识产权相融合的趋势日益明显,技术标准的内容也由原来的只是普通技术规范向包含一定的受知识产权法保护的智力成果的方向转变。这种变化的结果就是强化了知识产权人在市场竞争中的优势地位,导致知识产权领域内原有的利益平衡架构受到了极大的冲击。本文在分析技术标准具有的管理公共事务的职能与知识产权的私权属性之间矛盾的基础上,对知识产权与技术标准相结合的原因进行了一定程度的探讨,指出科学技术的迅猛发展、技术标准所具有的壁垒作用以及知识产权人对其个人利益最大化的追求是智力成果标准化趋势出现的重要原因。然后本文通过对智力成果标准化所引发的知识产权“权力”化现象的分析,指出了知识产权人利用其优势地位滥用知识产权的必然性,并进而对在智力成果标准化背景下,如何对知识产权人的权利进行规制进行了一定程度的探讨,指出在利用知识产权制度中的利益平衡机制进行调整的同时,还有必要以民法基本原则、反垄断法为工具,对知识产权人的权利进行外部制约。
[Abstract]:In the traditional concept, intellectual property rights with private property and technical standards as public affairs management tools are mutually exclusive.However, with the advent of the information revolution, the trend of the integration of technical standards and intellectual property rights is increasingly obvious. The content of technical standards has also changed from the original general technical norms to the direction of containing certain intellectual achievements protected by intellectual property law.The result of this change is to strengthen the dominant position of intellectual property owners in the market competition, resulting in the original interests balance in the field of intellectual property has been greatly impacted.On the basis of analyzing the contradiction between the function of managing public affairs and the property of private rights of intellectual property, this paper probes into the reasons for the combination of intellectual property and technical standard to a certain extent.It is pointed out that the rapid development of science and technology, the barrier function of technical standards and the pursuit of maximization of their personal interests by intellectual property owners are the important reasons for the emergence of the standardization trend of intellectual achievements.Then, by analyzing the phenomenon of intellectual property rights "power" caused by intellectual achievement standardization, this paper points out the inevitability that intellectual property owners abuse intellectual property rights by using their dominant position, and then analyzes the necessity of intellectual property rights being abused under the background of intellectual achievement standardization.This paper discusses how to regulate the rights of intellectual property rights to a certain extent, and points out that it is necessary to use the basic principles of civil law and anti-monopoly law as a tool to adjust the interests balance mechanism in the intellectual property system.External restriction on the rights of intellectual property owners.
