港口经营人相关法律问题研究

【摘要】:港口对促进国民经济的快速发展发挥着越来越重要的作用,然而,目前港口法律环境却存着与港口发展形势不相适应的地方。《港口法》虽然出台,遗憾的是该部法律仅仅调整了港口纵向的行政法律关系,对港口横向的民事法律关系却没有规范,在港口经营过程中产生的民事法律问题适用运输法律还是适用一般的民法和合同法,仍是需要迫切回答的问题。港口经营人的法律地位是解决港口民事法律关系的基础,结合我国港口经营人的实际,,深入研究港口经营人的法律地位,具有重要的理论与实践意义。本文试图做这方面的探索。 本文第一章介绍了港口的定义、分类以及今后的发展前景,简要分析了港口立法的演变过程,港口立法大致分三个阶段,第一阶段是95年以前,没有单独的港口立法,调整承运人的法律法规同时也规范港口法律关系。第二阶段是95年—2003年,这期间港口法律关系逐渐从运输法律关系中分离出来,2001年交通部颁布了专门调整港口民事法律关系的部门规章《港口作业规则》。第三阶段是2003年以后,港口立法上升为法律,《港口法》颁布实施。 第二章着重分析了我国港口经营人的定义和范围。 第三章通过几个案例说明了目前司法审判实际中对港口经营人法律定位的三种观点,分析了三种观点的利弊,并通过国际公约中港口经营人法律定位的变化,得出港口经营人应确立为实际承运人的结论。 第四章在港口经营人确立为实际承运人法律地位的前提下,分析了港口经营人的法律责任,包括港口经营人责任的性质、责任期间,责任限制等。 第五章提出了修订《海商法》中有关实际承运人规定的立法建议,扩大实际承运人的范围,把港口经营人纳入到实际承运人的范围内进行调整。
[Abstract]:Ports play an increasingly important role in promoting the rapid development of the national economy. However, at present, the port legal environment is not suitable for the port development situation. Unfortunately, the Ministry's law only adjusts the longitudinal administrative and legal relationship of the port, but it does not regulate the horizontal civil legal relationship of the port. It is still an urgent question whether to apply the transportation law or to apply the general civil law and contract law in the process of port operation. The legal status of the port operator is the basis of solving the legal relationship of port civil affairs. It is of great theoretical and practical significance to study the legal status of the port operator in depth in combination with the reality of the port operator in our country. This article attempts to do this aspect of exploration. The first chapter introduces the definition, classification and future development prospects of the port, and briefly analyzes the evolution process of the port legislation. The port legislation is roughly divided into three stages. The first stage is before 95 years, and there is no separate port legislation. Adjust the carrier's laws and regulations, but also regulate port legal relations. The second stage was from 1995 to 2003, during which the port legal relationship was gradually separated from the transport legal relationship. In 2001, the Ministry of Communications promulgated the regulations of the Department of Port Operations which specially regulated the port civil legal relations. The third stage is after 2003, the port legislation rises to the law, the Port Law is promulgated and implemented. The second chapter analyzes the definition and scope of port operator in China. The third chapter explains the three views on the legal positioning of port operators in the judicial practice through several cases, analyzes the advantages and disadvantages of the three views, and changes the legal positioning of port operators through the international conventions. Draw the conclusion that the port operator should be established as the actual carrier. The fourth chapter analyzes the legal liability of the port operator under the premise that the port operator is established as the actual carrier, including the nature of the liability of the port operator, the period of liability, the limitation of liability and so on. The fifth chapter puts forward the legislative proposals to amend the provisions of the actual carrier in the Maritime Law, to expand the scope of the actual carrier and to bring the port operator into the scope of the actual carrier for adjustment.
