【摘要】：农业保险法的基本原则是指贯穿整个农业保险法，体现农业保险法根本价值，，并规范农业保险法立法、司法、执法、守法活动的根本准则。它是农业保险法在调整农业保险关系中的价值追求，是农业保险法律体系的神经中枢。农业保险法的基本原则具有价值的取向性、内容的根本性、适用的普遍性、功能的强行性和补充性、形式的非规范性和不确定性等特征。在功能上，它具有立法准则功能、行为准则功能、审判准则功能、体系统帅功能。农业保险法基本原则的确定不仅可以深化农业保险研究，优化保险理论体系，而且还可以支持农业保险立法并促进农业保险的发展。农业保险法基本原则的内容决定于农业保险法基本原则的评判标准。学界对农业保险法基本原则的内容众说纷纭，原因就是评判标准不一。借鉴商法基本原原则的评判标准，可知，农业保险法基本原则的评判标准应为：一是反映农业保险法所调整的社会关系；二是体现农业保险法的根本价值；三是体现农业保险法的基本内容；四是统辖农业保险法的具体法律制度。基于农业保险法基本原则的评判标准，农业保险法基本原则的内容包括：社会效益最大化原则、政府与市场共同调节农业保险原则、政府与全社会共同支持农业保险发展原则、积极推进农业保险组织制度创新与经营技术创新原则、因地制宜与循序渐进地发展农业保险原则。
[Abstract]:The basic principle of the agricultural insurance law is the basic principle that runs through the whole agricultural insurance law, embodies the fundamental value of the agricultural insurance law, and standardizes the legislation, judicature, law enforcement and law-abiding activities of the agricultural insurance law. It is the value pursuit of agricultural insurance law in adjusting the relationship between agricultural insurance and the nerve center of agricultural insurance legal system. The basic principles of agricultural insurance law have the characteristics of value orientation, fundamental content, universality of application, compulsion and supplement of function, non-standard and uncertainty of form and so on. In terms of function, it has the function of legislative norm, code of conduct, criterion of judgment, function of system commander-in-chief. The determination of the basic principles of agricultural insurance law can not only deepen the research of agricultural insurance, optimize the theoretical system of insurance, but also support the legislation of agricultural insurance and promote the development of agricultural insurance. The content of the basic principles of the agricultural insurance law is determined by the evaluation standard of the basic principles of the agricultural insurance law. The academic circles have different opinions on the basic principles of agricultural insurance law, the reason is that the criteria are different. Based on the evaluation criteria of the basic principles of commercial law, we can see that the basic principles of agricultural insurance law should be judged according to the following criteria: first, reflecting the social relations adjusted by the agricultural insurance law; second, reflecting the fundamental value of the agricultural insurance law; The third is to embody the basic contents of the agricultural insurance law, and the fourth is to govern the specific legal system of the agricultural insurance law. Based on the evaluation criteria of the basic principles of agricultural insurance law, the basic principles of agricultural insurance law include the principle of maximizing social benefits, the principle of government and market regulating agricultural insurance, the principle of government and the whole society jointly supporting the development of agricultural insurance. The principles of agricultural insurance organization system innovation and management technology innovation should be actively promoted, and agricultural insurance principles should be developed step by step according to local conditions.
