【摘要】：针对我国海商法中实际承运人制度在理论研究和实际运用中的分歧,从多个角度来探究实际承运人法律制度,清晰地界定了“实际承运人”这一概念,划分了实际承运人和承运人的责任范围,分析了实际承运人责任性质及责任追究的程序,以期对完善实际承运人法律制度有所裨益。
[Abstract]:In view of the differences in the theoretical research and practical application of the actual carrier system in China's maritime law, this paper probes into the actual carrier's legal system from many angles and clearly defines the concept of "actual carrier". This paper divides the scope of the actual carrier and the carrier's liability, analyzes the nature of the actual carrier's liability and the procedure for the investigation of the actual carrier's liability, in order to be of benefit to the perfection of the actual carrier's legal system.
