【摘要】:本文所称的不动产物权变动制度是指一个国家或地区的民事民法 实体法,对基于合同行为的不动产物权变动进行法律调控而建立的制 度。这个制度是物权法的核心,是我国制定物权法必须解决的关键问题, 当然也是目前在理论界存在争议较多的问题。本文采用了比较分析的方 法,对不动产物权变动制度及我国不动产物权变动制度的构建进行了粗 浅的探讨。全文包括引言、主文和结束语三部分。主文分为四章,内容 概要如下: 第一章:不动产与不动产物权变动制度。在本章中对不动产的定义、 动产与不动产分类的历史及区分不动产和动产的意义进行了探讨。在对 不动产物权变动的基本含义和起因进行分析的基础上,指出本文所要研 讨的核心内容一基于合同行为的不动产物权变动。 第二章:几个典型国家不动产物权变动制度研究。在本章中探讨了 大陆法系三个国家以及英美法系两个国家不动产物权变动制度的形成 的社会历史条件、法制背景及不动产物权变动制度的基本结构。并对各 种制度的优缺点进行了简单的评析。 第三章:我国不动产物权变动制度的历史及状况。在本章中对我国 不动产物权变动制度的历史沿革进行了考察,认为不动产物权变动登 记在我国历史悠久;我国目前的不动产物权变动制度散见于单行法规 中,还没有完整意义上的不动产物权变动制度。认为我国现行法并未承 认物权行为。 第四章:我国不动产物权变动制度的构建。在本章中首先探讨了构
[Abstract]:The system of real property right change refers to the substantive law of civil law in a country or region. The system of real estate property right change based on contract act is regulated by law. This system is the core of the real right law and the key problem that must be solved in the formulation of the property law in our country. Of course, it is also a controversial issue in the theoretical circle at present. The square method of comparative analysis is used in this paper. This paper discusses the system of real property right change and the construction of real estate property right change system in China. The full text includes three parts: introduction, subject and conclusion. The main text is divided into four chapters, the content is summarized as follows: the first chapter: real estate and real property rights change system. In this chapter, the definition of immovable property, the history of the classification of movable property and immovable property and the significance of distinguishing immovable property from movable property are discussed. On the basis of analyzing the basic meaning and cause of real property right change, The author points out that the core content of this paper is the change of real property right based on contract act. Chapter two: research on the system of real estate right change in several typical countries. In this chapter, we discuss the formation of real estate right change system in three countries of continental law system and two countries of common law system Social and historical conditions, The background of legal system and the basic structure of real estate right change system. And the advantages and disadvantages of each system are briefly evaluated. Chapter three: the history and status of real estate right change system in our country. In this chapter, the author investigates the history of the system of real estate right change in our country. The author holds that the registration of real property right change has a long history in our country. The current system of real property right change in our country is scattered in the separate laws and regulations, but there is no real estate property right change system in a complete sense. The author thinks that the current law of our country does not admit the act of real right. Chapter four: the construction of the system of real estate right change in our country. In this chapter, we first discuss the structure.
