提单持有人诉权制度研究

【摘要】:本文研究国际海上货物运输领域,提单项下提单持有人向承运人及非承运人提出索赔的诉权问题,旨在通过对国内外海商法以及相关国际公约就诉权问题立法的分析,并结合提单持有人诉权的理论分析,全面论述提单持有人诉权问题产生的根源和解决该问题的思路,为我国海商法将来的修改和完善提出参考性意见和建议。 本文主要采用对比研究、法解释学等研究方法,遵循提出问题、分析问题、解决问题的思路,对提单持有人诉权法律问题进行探究。 本文共分为正文和结语两个部分,其中正文包含四章。 第一章简要叙述本文写作的动因及目的,通过对提单持有人诉权现状分析,归纳出产生提单持有人诉权存在的问题,供下文逐一进行讨论。 第二章通过对提单持有人诉权产生的历史渊源的分析,得出提单持有人诉权产生的必然性和存在的重要性。 第三章通过对国内外海商法以及相关国际公约对提单持有人诉权的法律规定分析,得出提单持有人诉权应该由各国国内法加以规制,国际公约对提单持有人诉权调整只能是原则性的。 第四章从分析提单持有人诉权的理论依据出发,通过对提单法律关系的分类寻找提单持有人诉权的合理依据,得出提单持有人在对承运人提起诉讼时,依据是提单债权属性从而提起违约之诉,提单持有人在对非承运人提起诉讼时,依据是提单物权属性从而提起侵权之诉。 第五章通过对我国《海商法》中提单持有人诉权法律规定的评析,提出我国《海商法》的修改意见,即应该对提单持有人法律地位加以明晰并明确确立提单持有人诉权制度以保护提单持有人法律权益。 结论部分对本文主要内容进行概括。
[Abstract]:In the field of international carriage of goods by sea, this paper studies the litigation rights of bill of lading holders against the carrier and non-carrier under bill of lading, in order to analyze the legislation of litigation rights in domestic and foreign maritime law and related international conventions. Combined with the theoretical analysis of the right of action of the holder of bill of lading, this paper comprehensively discusses the origin of the right of action of the holder of the bill of lading and the way of thinking to solve the problem, and puts forward some suggestions and suggestions for the future revision and perfection of maritime law of our country. This paper mainly adopts comparative research, legal hermeneutics and other research methods, following the idea of raising questions, analyzing problems and solving problems, and probes into the legal problems of bill of lading holders' right of action. This paper is divided into two parts: the text and the conclusion, in which the text contains four chapters. The first chapter briefly describes the motivation and purpose of this writing, through the analysis of the status quo of the right of action of the holder of the bill of lading, summarizes the existing problems of the right of action of the holder of the bill of lading, which is discussed one by one below. The second chapter analyzes the historical origin of the right of action of the holder of bill of lading, and concludes the inevitability and the importance of existence of the right of action of the holder of the bill of lading. The third chapter through the domestic and foreign maritime law as well as the related international convention to the bill of lading holder's right of action legal provisions analysis, the conclusion that the bill of lading holder's right of action should be regulated by the domestic law of various countries. International conventions can only adjust the litigation rights of bill of lading holders in principle. The fourth chapter analyzes the theoretical basis of the bill of lading holder's right of action, through the classification of the legal relationship of the bill of lading to find the reasonable basis of the bill of lading holder's right of action, and draws the conclusion that the holder of the bill of lading brings an action against the carrier. The basis is the property of the bill of lading and the action of breach of contract. When the holder of the bill of lading brings an action against the non-carrier, it is based on the property of the bill of lading and the action of infringement. The fifth chapter, through the analysis of the legal provisions of the bill of lading holder's right of action in China's Maritime Law, puts forward the opinions on the amendment of our country's Maritime Law. That is to say, the legal status of bill of lading holders should be clarified and the system of litigation rights of bill of lading holders should be established to protect the legal rights and interests of bill of lading holders. The conclusion part summarizes the main contents of this paper.
