论债的保全

【摘要】：债的保全,是民事法律制度中的一项重要制度,也是债权法的重要内容,对于债权的保障具有重要作用。国内法学界对此尚未进行深入研究,司法实务中也存在一些亟待解决的问题。本课题研究旨在通过对债权人代位权和债权人撤销权的研究,通过与其他国家的法律立法现状比较、实证分析的研究,从而指出我国当前设立债的保全制度中存在的不尽完善的问题,提出完善债的保全制度的构想。
[Abstract]:The preservation of debts is an important system in the civil legal system and also an important content of the creditor's rights law, which plays an important role in the protection of the creditor's rights. There are still some problems to be solved in the judicial practice. The purpose of this research is to study the creditor's subrogation right and creditor's revocation right, and to compare the present situation of legislation with other countries, and to study the empirical analysis of the right of creditor's subrogation and creditor's rescission right. This paper points out the imperfect problems in establishing the debt preservation system in our country, and puts forward the idea of perfecting the debt preservation system.
