船舶优先权制度研究

【摘要】:船舶优先权是海商法特有的一项法律制度,但由于各国的基本法律制度存在差异,因此在船舶优先权的行使过程中亦存在冲突,在我国,《海商法》颁布的时间较晚,因而关于船舶优先权的理论研究相对来说还不够成熟,在实践中常常出现歧义。本文选择船舶优先权制度为研究对象,以我国《海商法》为基础,结合国际公约和主要海运国家的有关法律,用比较法学的研究方法,对我国船舶优先权的立法进行分析评述,并对存在问题提出自己的见解及修改立法建议。 本文第一章简要介绍了船舶优先权起源和诸种学说及船舶优先权在各国的发展状况,分析了船舶优先权发展的国际统一化趋势。介绍了英美学者对船舶优先权下的定义,分析了我国《海商法》船舶优先权定义的含义,指出定义没有反映船舶优先权性质和船舶优先权与海事请求是一种担保与被担保的关系等缺陷。介绍了英美学者对船舶优先权的法律特征的认识,结合我国《海商法》规定,阐述了船舶优先权具有法定性、秘密性、从属性、追及力、优先性、独立时效性、程序性等法律特征。运用比较方法论证阐述了船舶优先权的性质是一种实体权利,一种法定担保物权,而不是一种债权,更不是一种程序权利。 第二章,分别论述了船舶优先权的客体(标的)、主体(权利主体船舶优先权人和义务主体船舶优先权所担保的海事请求的被请求人)和内容(船舶优先权项目)三要素,结合主要海运国家、国际公约和我国《海商法》有关船舶优先权
[Abstract]:Maritime lien is a special legal system of maritime law, but there are conflicts in the exercise of maritime liens because of the differences in the basic legal systems of various countries. In our country, the time of promulgation of Maritime Law is relatively late. Therefore, the theoretical research on maritime liens is relatively immature, and ambiguity often occurs in practice. This paper chooses maritime lien system as the research object, based on the maritime law of our country, combines the international convention and the relevant laws of the major maritime countries, and makes an analysis and comment on the legislation of maritime lien in our country by the method of comparative law. And puts forward own opinion to the existence question and the revision legislation proposal. The first chapter briefly introduces the origin of maritime liens and various theories and the development of maritime liens in various countries, and analyzes the trend of international unification of maritime liens development. This paper introduces the definition of maritime lien by British and American scholars, and analyzes the definition of maritime lien in China. It is pointed out that the definition does not reflect the nature of maritime liens and the relationship between maritime claims and maritime liens. This paper introduces the understanding of the legal characteristics of maritime liens by British and American scholars, combining with the provisions of Maritime Law of our country, expounds that maritime liens have legal nature, secrecy, subordinate attribute, pursuit and force, priority, independent timeliness, etc. Procedural and other legal features. This paper demonstrates that the nature of maritime lien is a kind of substantive right, a kind of legal security right, not a kind of creditor's right, much less a procedural right. The second chapter discusses the object of maritime lien (the object), the subject (the subject of maritime lien and the claimant of maritime claim guaranteed by the subject of maritime lien) and the content (maritime lien item).
