国际货物多式联运经营人责任制度研究

【摘要】: 国际货物多式联运在世界经济发展中的地位越来越重要,对于我国这样一个发展中国家而言更是如此。自国际货物多式联运诞生以来就一直呼唤着联运经营人责任制度的法律统一,然而至今仍然没有一部具有法律效力的国际货物多式联运公约,这极大的制约了货物多式联运以及国际贸易的发展。我国有关国际货物多式联运的法律同样不能很好的满足多式联运业发展的需要,亟待完善和发展。 本文从传统民商法的基本原理出发,对世界各国和地区相关法律制度以及现有公约与规则采用比较分析的方法,同时合理借鉴法律经济学的相关理论和观点,对国际货物多式联运予以界定,对国际货物多式联运经营人与货运代理人、港站经营人的法律地位,他们之间以及他们与货物利益方之间的权利义务关系进行分析,并在此基础上着重对货物多式联运的核心法律问题,,即多式联运经营人责任制度进行研究,并对国际货物多式联运经营人责任制度的统一进行探讨,最后本文提出我国多式联运经营人责任制度的初步法律框架,希望能对国际以及我国多式联运经营人责任制度的研究和完善有所助益。
[Abstract]:International multimodal transport of goods plays an increasingly important role in the development of world economy, especially for a developing country like China. Since the birth of international multimodal transport of goods, it has been calling for the unification of the law of the liability system of intermodal transport operators. However, there is still no international convention on multimodal transport of goods with legal effect. This greatly restricted the development of multimodal transport of goods and international trade. The law on international multimodal transport of goods in our country can not meet the needs of the development of multimodal transport industry, so it needs to be perfected and developed. Based on the basic principles of traditional civil and commercial law, this paper adopts a comparative analysis of the relevant legal systems and existing conventions and rules of various countries and regions in the world, and at the same time, reasonably draws lessons from the relevant theories and viewpoints of law and economics. Definition of international multimodal transport of goods, analysis of the legal status of international cargo multimodal transport operators and freight forwarders, the legal status of operators at port stations, their rights and obligations as well as the relationship between them and the parties to the goods, On this basis, the core legal issues of multimodal transport of goods, namely, the liability system of multimodal transport operators, are emphatically studied, and the unification of the liability system of international multimodal transport of goods is discussed. Finally, this paper puts forward the preliminary legal framework of the liability system of multimodal transport operators in China, hoping to be helpful to the research and improvement of international and Chinese multimodal transport operators' liability system.
