论信息网络传播权及其限制

【摘要】： 2001年10月27曰，我国修改后的著作权法颁布，该法增加 了网络环境下著作权保护新的权利内容，即“信息网络传播权”。 法律还规定该权利的保护办法由国务院另行制订。此文之目的即 在于合理界定该权利的范围，保护版权人利益，为我国网络版权 保护的立法提供参考。 为适应网络传播环境，各发达国家相继修改了版权法。我国 在法律修改前也作了应急性规定，，其后法律修改的内容基本上符 合国际条约对确立作者的网络传播权的要求。网络传播的特点对 著作权法理论与实践有很大的冲击，要制订出好的网络传播权保 护法规就必须充分考虑技术因素。这些因素对合理确定网络传播 权的名称、主体、客体有重要的参考价值，都值得研究。在网络 传播权的实践领域，网络传播的特点决定了我们应确立网络传播 者权利，建立专门针对网络传播权的著作权集体管理组织。 网络传播权法规的规范重点——权利限制，是对利益平衡理 论的具体应用，文章认为利益应适当向使用者一方倾斜，此种价 值取向有比较充足理由。在此前提下，网络传播权法规可借鉴著 作权法规定的及其规定之外的权利限制各个方面的经验，比如怎 样划定合理使用和法定许可的范围，是否规定适用默示许可的网 络传播行为等等。网络环境下，网络传播者不应该承担过于严厉 的作品侵权赔偿责任，网络传播权法规应给网络传播者划定免责 范围，以缩小其经营风险，巩固作品网络传播的物质基础。 目前我国网络传播权法规的立法环境已渐成熟。文章在讨论 了网络传播权各方面内容后，结合国外有关立法重点，对我国网 络传播权法规的立法提出了具体的操作性建议。
[Abstract]:On October 27, 2001, the revised copyright Law of our country was promulgated, which added the new right content of copyright protection under the network environment, that is, the right of information network dissemination. The law also stipulates that the measures for the protection of this right shall be formulated separately by the State Council. The purpose of this paper is to reasonably define the scope of the right, protect the interests of copyright owners, and provide reference for the legislation of network copyright protection in our country. In order to adapt to the network communication environment, developed countries have amended copyright laws one after another. China has also made urgent provisions before the amendment of the law, and the contents of the subsequent legal amendments basically conform to the requirements of international treaties for the establishment of the author's right of network communication. The characteristics of network communication have a great impact on the theory and practice of copyright law. In order to formulate a good network communication copyright protection law, we must fully consider the technical factors. These factors have important reference value for reasonably determining the name, subject and object of network communication right, and are worth studying. In the practical field of network communication right, the characteristics of network communication determine that we should establish the right of network communicator and establish a copyright collective management organization specially aimed at the right of network communication. The normative focus of the laws and regulations on the right of network communication, the restriction of rights, is the concrete application of the theory of balance of interests. The article holds that the interests should be appropriately tilted to the user side. There is a good reason for this kind of price value orientation. On this premise, the laws and regulations of the right of network communication can draw lessons from the experience of various aspects of the limitation of rights stipulated in the copyright law and its provisions. For example, how to define the scope of reasonable use and legal license, whether to provide for the application of implied licensing network communication behavior and so on. Under the network environment, the network communicator should not assume too strict liability for infringement of works, and the right of network communication law should define the scope of exemption for the network communicator. In order to reduce its business risk and consolidate the material basis of the network dissemination of works. At present, the legislative environment of network communication rights laws and regulations in China has gradually matured. In this paper, after discussing all aspects of the right of network communication, combined with the emphasis of legislation abroad, the author puts forward some practical suggestions on the legislation of network broadcasting right in our country.
