城市道路沿线居民“增强利用权”的确立与保护

【摘要】："增强利用权"在德国法中是针对"一般利用"的一种加重情况,是比照一般利用者并超出一般利用权的权利。城市道路沿线居民对其居住的道路路边停车位,基于习惯利用或承担了一般利用人所未承担的义务而具有"增强利用权"。"增强利用权"优先于一般利用权,但不得禁止或排除他人的一般利用权。地方立法可以通过试行方式逐步在我国公物立法中确立"增强利用权"。立法应采用第三方评估的方式对于"增强利用权"的重大争议事项进行评估。新修改的《中华人民共和国行政诉讼法》中关于原告、诉讼代表人、第三人的新规定为受行政机关侵犯"增强利用权"的城市道路沿线居民提供了司法救济和保护的途径。
[Abstract]:"Strengthening the right to use" is an aggravation of "general use" in German law, which is the right to take advantage of the general use and exceed the general use right. Residents along the urban road have "enhanced use rights" on the roadside parking spaces that they live on, which are based on habitual use or assume general obligations of human beings. "Strengthening the right to use" is given priority to the general use of rights, but it is not allowed to prohibit or exclude the general use of other people's rights. Local legislation can gradually establish "strengthen the right to use" in the public property legislation of our country by the way of trial. The third party assessment should be used in the legislation to assess the major issues of "enhanced use rights". The new regulation on plaintiff, litigation representative and third party in the newly revised administrative procedure law of the People's Republic of China provides a way of judicial relief and protection for the residents along the urban roads which are infringed by the administrative organs.
