我国刑事法律援助的实施现状与对策建议——基于2013年《刑事诉讼法》施行以来的考察与思考

【摘要】：2012年刑事诉讼法修改中刑事法律援助制度发生了重要变化和显著进步。2014年笔者先后到十个省、市的30多个法律援助机构对2013年1月1日以来刑事法律援助新规定的执行情况进行了考察,所取得的大量实证调研数据、信息反映了执行的现状和存在的问题及其原因。在此基础上,有针对性地从五个方面提出了对策建议:其一,各级公安司法机关应当高度重视刑事法律援助工作;其二,各级政法委应当加强对刑事法律援助实施的执法检查和监督;其三,对于应当通知而没有通知造成没有律师辩护的案件应当建立程序无效制度;其四,多方努力、多措并举,解决刑事法律援助经费不足的问题;其五,司法行政机关应当在内部管理上解决好影响刑事法律援助工作的若干具体问题。
[Abstract]:In the amendment of the criminal procedure law in 2012, the system of criminal legal aid has undergone significant changes and remarkable progress. The implementation of the 2014 successively to ten provinces and municipalities of the more than 30 legal aid institutions of criminal legal aid since January 1, 2013 new regulations were investigated, a large number of empirical research data, the information obtained to reflect the implementation of the present situation and the existing problems and reasons. On this basis, targeted from five aspects and puts forward some countermeasures and suggestions: first, the public security and judicial organs at all levels should attach great importance to the criminal legal aid work; second, at all levels of politics and Law Committee shall strengthen the inspection of law enforcement and supervision of the criminal legal aid implementation; thirdly, the notice shall be without notifying the cause without a lawyer case the program should establish the invalid system; fourthly, efforts, Duocuobingju, solve the problem of inadequate funding for criminal legal aid; fifth, some specific issues in the judicial and administrative organs should solve in the internal management of criminal legal aid work.
