【摘要】：江伟老师的民事诉讼基本理论研究建树颇丰,其对于民事诉讼基本理论的各方面研究都是走在了当时时代的前沿,并结合司法实践、关注实践问题。江伟老师在长期的研究过程中逐步将民事诉讼基本理论体系的内容明确为包括民事诉讼价值理论、民事诉讼目的理论、诉权理论、诉讼标的理论和既判力理论。本文从江伟老师民事诉讼基本理论体系的基石理论——民事诉讼价值理论入手,深入分析其强调“程序内在独立价值”的司法实践上的动因及学术理论上的基础,并以此为展开对江伟老师的民事诉讼基本理论体系构建中的细节加以研究、分析,并就其民事诉讼各基本理论本身在新的社会情况下及遭遇理论挑战时的处理与应对进行再思考,以进一步揭示江伟老师在民事诉讼基本理论体系中的深刻学术思想。
[Abstract]:Jiang Wei's research on the basic theory of civil procedure has made a lot of achievements. His research on all aspects of the basic theory of civil procedure was at the forefront of the times and combined with judicial practice. Attention to practical issues. In the long process of research, Jiang Wei gradually defined the content of the basic theoretical system of civil action, including the theory of value of civil action, the theory of purpose of civil litigation, and the theory of right of action. The theory of object of litigation and the theory of res judicata. This paper starts with the theory of civil litigation value, which is the cornerstone of Jiang Wei's basic theory system of civil litigation. It deeply analyzes the causes of judicial practice and the academic theoretical basis of emphasizing the "intrinsic independent value of procedure", and studies the details in the construction of the basic theoretical system of civil litigation of Mr. Jiang Wei. The author analyzes and rethinks the basic theories of civil action in the new social situation and when facing the theoretical challenge. In order to further reveal Jiang Wei's profound academic thoughts in the basic theoretical system of civil litigation.
