网络跨境代购中走私普通货物、物品犯罪的司法认定

【摘要】：如今,网络跨境代购受到越来越多人的追捧,但最近发生的淘宝店主代购案和空姐代购案也暴露了网络跨境代购在蓬勃发展背后的法律问题。虽然法律、政策的相继出台使得网络跨境代购的代购商无利可图,但是他们却没有因此望而却步。据相关调查显示,很多代购商利用法律仅有的“合法空隙”来规避税收牟取暴力,使自己在网络跨境代购行业中占据绝对优势。笔者认为,由于对现有政策与法律的理解与执行不当,司法实践中很多问题没有得到清晰的认定,相关执法、司法部门之间的配合机制不协调,很多违法的行为人钻了法律的空子,没有得到真正的惩罚,而使更多人相信如此作为不会有法律风险。因此,在司法实践中进一步规制网络跨境代购中走私普通货物、物品犯罪显得极为重要,这也是本文研究的主要问题。本文共分为五章：第一章主要是论文的选题背景,研究目的和意义,研究方法的综合概括；第二章是网络跨境代购中走私普通货物、物品犯罪的概述,由空姐代购案作为导入,引出对网络跨境代购中走私普通货物、物品犯罪概念的界定。总结了网络跨境代购中走私普通货物、物品犯罪的三个特征,即犯罪行为具有涉税性、隐蔽性、双重违法性。进而分析了网络跨境代购中走私普通货物、物品犯罪的危害性；第三章是文章的重点部分,总结了网络跨境代购的司法认定现状及其存在的问题,如犯罪嫌疑人难以确定、犯罪对象认定标准不统一、犯罪数额难以认定、犯罪证据难以收集；第四章笔者针对上述问题提出了解决方案,包括以事实和法律双重标准为原则确认犯罪嫌疑人、以行为目的认定对象、统一数额认定标准、完善证据收集机制、建立信息共享渠道等措施；第五章,总结全文。
[Abstract]:Nowadays , network cross - border overseas purchasing is more and more popular , but the recent Taobao shop owner purchasing case and the elder sister purchasing case also expose the legal problems behind the flourishing development of the network cross - border overseas purchasing . Although the laws and policies have been introduced in succession , many problems in the judicial practice have not been clearly identified , and the cooperation mechanism between the relevant law enforcement and the judiciary is not coordinated . Many illegal actors have drilled the laws and have not got real punishment . Therefore , it is extremely important to further regulate the smuggling of ordinary goods in cross - border overseas purchasing in judicial practice , which is also the main problem in this paper . This paper is divided into five chapters : the first chapter is mainly the background , the purpose and the significance of the thesis , the comprehensive summary of the research method ; the second chapter is the summary of the smuggling of ordinary goods and articles in the cross - border purchasing of the network .
